copyright infringement Gonzales proposes new crime: 'Attempted' copyright infringement http://news.com.com/8301-10784_3-9719339-7.html Attorney General Alberto Gonzales is pressing the U.S. Congress to enact a sweeping intellectual-property bill that would increase criminal penalties for copyright infringement, including "attempts" to commit piracy. "To meet the global challenges of IP crime, our criminal laws must be kept updated," Gonzales said during a speech before the U.S. Chamber of Commerce in Washington on Monday. The Bush administration is throwing its support behind a proposal called the Intellectual Property Protection Act of 2007, which is likely to receive the enthusiastic support of the movie and music industries, and would represent the most dramatic rewrite of copyright law since a 2005 measure dealing with prerelease piracy. The IPPA would, for instance: * Criminalize "attempting" to infringe copyright. Federal law currently punishes not-for-profit copyright infringement with between 1 and 10 years in prison, but there has to be actual infringement that takes place. The IPPA would eliminate that requirement. (The Justice Department's summary of the legislation says: "It is a general tenet of the criminal law that those who attempt to commit a crime but do not complete it are as morally culpable as those who succeed in doing so.") * Create a new crime of life imprisonment for using pirated software. Anyone using counterfeit products who "recklessly causes or attempts to cause death" can be imprisoned for life. During a conference call, Justice Department officials gave the example of a hospital using pirated software instead of paying for it. * Permit more wiretaps for piracy investigations. Wiretaps would be authorized for investigations of Americans who are "attempting" to infringe copyrights. * Allow computers to be seized more readily. Specifically, property such as a PC "intended to be used in any manner" to commit a copyright crime would be subject to forfeiture, including civil asset forfeiture. Civil asset forfeiture has become popular among police agencies in drug cases as a way to gain additional revenue, and it is problematic and controversial. * Increase penalties for violating the Digital Millennium Copyright Act's anticircumvention regulations. Criminal violations are currently punished by jail times of up to 10 years and fines of up to $1 million. The IPPA would add forfeiture penalties. * Add penalties for "intended" copyright crimes. Certain copyright crimes currently require someone to commit the "distribution, including by electronic means, during any 180-day period of at least 10 copies" valued at more than $2,500. The IPPA would insert a new prohibition: actions that were "intended to consist of" distribution. * Require Homeland Security to alert the Recording Industry Association of America. That would happen when CDs with "unauthorized fixations of the sounds, or sounds and images, of a live musical performance" are attempted to be imported. Child pornography is illegal because the production itself involves actual victims. The laws date back to a time when it wasn't possible to produce CP without actual children. It therefore made sense that sale, distribution and possession of actual child pornography was made illegal, but the slippery slope started when the governments around the world began to outlaw child pornography without actual victims. The first prohibition does not violate free speech, because the material featuring actual children is integral to criminal conduct, but the second prohibition on computer generated images and cartoons is a regulation of thought. And Julian and others are really missing the point if they assume that the realistic nature of the depictions is the borderline between permissible and impermissible speech. The Supreme Court of the United States ruled in one of its more speech friendly cases that regulation of virtual child pornography on the assumption that such will incite viewers thoughts is impermissible regulation of thought. You can't be an anarchist and defend thought crime legislation. Child pornography without actual participants is victimless speech and is no more abuse than crime comics, or ordinary adult pornography some want to ban. And yes, true untraceable anonymous communication can't coexist in a society with thought crime legislation. Rick Falkvinge has succinctly argued why child pornography laws in their current sweeping form pose a risk to privacy and free speech. The question is very simple: If the price for enforcing anti-child pornography laws is banning truly untraceable communication, enforcing EU style data retention on all data packets flowing over the network, is the price too high? [Freedombox-discuss] FreedomBox and Bitcoin (and the petition)

I'm just wondering if anybody has done any analysis of the suitability of Bitcoin for FreedomBox? For example, Bitcoin provides a certain amount of anonymity, but not complete privacy. In other words, anybody can create an anonymous Bitcoin account, but anyone else can trace the movements of Bitcoins through that account. Does this lack of 100% privacy make it awkward for FreedomBox to include Bitcoin? What Bitcoin does excel at is providing an alternative money supply. In previous eras of bank failure (e.g. over 9,000 US banks went pop in the 1930s) people reverted to gold and silver. Nowadays, so many of us are involved in businesses that rely on ecommerce and distant clients paying for virtual/intangible services. Most trade relies on electronic payment by bank transfer or credit card, not a physical meeting with cash. Iceland's banks went pop and it's been speculated that Greek banks will go the same way when they leave the Euro. It seems like fertile ground for a solution like Bitcoin deployed on a convenient platform like FreedomBox. There is also the diversity of businesses supported by Bitcoin - it can be very difficult for a business to start accepting credit card payments, banks often insist that the business already has capital or real estate. But any start-up business can accept Bitcoin payment without such discrimination. Back to the original question though: do these potential social benefits outweigh the lack of 100% privacy in Bitcoin? Is there a `privacy threshold' for something to be included in FreedomBox? Above the clatter of sewing machines, many tailors told Reuters on Wednesday that inspectors had warned them against selling uniforms to people without a military identification card. "Every two weeks there is a police inspection at our shops," Indian tailor Ulom said in his tiny shop, one of several lining Riyadh's al-Wazir street where the bulk of uniforms are made. "If I don't ask for IDs, I could be arrested," he says, holding his hands in a cuffed position. The government began restricting access to uniforms after al Qaeda militants, in military or police gear, escalated their battle against the government and the Western residents they regard as "infidels". In one of the bloodiest attacks by Osama bin Laden's group, militants masquerading as security men killed 22 civilians in a May shooting and hostage-taking spree in the oil city of Khobar. In November 2003, suicide bombers also got into a Riyadh housing compound by dressing up as security forces. At least 18 people, mainly Arabs and Muslims, were killed in that attack. And repeating a frequent claim, al Qaeda said in an Internet publication that some policemen had helped them kidnap U.S. engineer Paul Johnson -- whom they beheaded last week -- by providing uniforms and cars. The government denied the report. At least 85 civilians and police have been killed by al Qaeda, blamed for the September 2001 attacks on U.S. cities. DEVIANTS The Saudi authorities say the militants often copy military costumes and paint cars in police colours. But some militants used to serve in the security forces and diplomats said they often use their IDs and contacts to legally obtain props. Saleh al-Awfi, tipped to be the new al Qaeda leader in the kingdom, was a former Interior Ministry employee. Mohammed, another Indian tailor, said he was happy to comply with the government regulations because he wants to make sure he is outfitting the "good guys" and not the "deviant faction". "By God, it's a crime what's happening," he said as he carefully measured green camouflage cloth. "But we only service people with military ID cards," he added, rising from his seat to greet a customer inspecting the boots, pistol holsters and name badges in the window display. Saudi forces won a major battle against the group on Friday when they shot and killed four prominent militants, including Saudi's al Qaeda leader Abdulaziz al-Muqrin. Despite the government's efforts, some Saudis say anybody can buy the costumes without the mandatory documents. The shop's provide uniforms for cadets at military school and officers. "Yes, there are restrictions but a trader will often forgo IDs for a profit," said one Saudi journalist. C-13, O-17 Responsible for all (?) CO2 Greenhouse effect

My name is James Dalton Bell. (MIT BS Chemistry, 1980). In late June 2009 I concluded that only the portion of the molecules of CO2 containing either a carbon-13 atom (1.1% of carbon in nature) or an oxygen-17 atom (0.038% of oxygen in nature) is responsible for most or all of the 'greenhouse effect' commonly attributed to CO2. In late July 2009 I wrote letters to Al Gore, 40 foreign embassies in Washington DC, and about 30 Congressional committees and government agencies (NIST; DOE) describing this. I stated that it would be relatively easy to remove the C-13 from natural gas and coal (via Fischer-Tropsch reaction, etc), and possibly from petroleum as well. In addition, oxygen could be distilled to remove most O-17 isotope in fixed applications (power plants). In December 2009 I wrote two certified letters (each) to Al Gore and Obama. So far, none of my letters have been answered. You can imagine the implications of this discovery. The problem, to the extent it may exist, is easily solved. Please help me confirm and publicize this news. Thank you.
