Dear Sir, I am writing to you either as a registered user of one of Systolix free DSP design tools (FilterExpress, FilterSim, FilterWizard), or because you have expressed an interest in our products. As part of our development activities we occasionally survey our software users for feedback on their ongoing DSP and software requirements. We are currently developing our next generation of DSP processors and tools, and would be grateful if you could take a minute to answer 4 simple questions. Declan offers his motion to quash the feds subpoena: http://www.mccullagh.org/subpoena/motion.032901.html Worth reading not for the customary hoary press privilege, but for the protection requested to avoid what Jim Bell allegedly wants to use McCullagh for, and for Declan's affirmation that he covers the " 'cypherpunk' movement," gathering and archiving information for future use. Did you write this yourself Declan or your mouthpiece working alone without privileged sources about what you intend for the "cypherpunk movement?" WTF movement, by the way is being alleged and what is the evidence being concocted? Smells like the feds are feeding the evidentiaries all around the legal and press privileged pigtroughs, jesus fucking christ.

Seth Finkelstein, reluctant cypherpunk?

It's important for cypherpunks to understand why Seth Finkelstein has (apparently) recently subscribed to the list. Seth is essentially an anti-cypherpunk, someone who violently disagrees with free-market points of view and has spent (a conservative estimate) hundreds of hours arguing against them. Seth's claim to fame is that he popularized the "Libertarianism Makes You Stupid" saying, popular among a small clutch of Net-leftists. An article he wrote: http://www.spectacle.org/897/finkel.html Obviously there are going to be some points of agreement. Seth is a liberal and a programmer who is going to like strong crypto, free speech (only the types the ACLU approves of, naturally), and so on. But on cases involving free trade, commercial speech, critiques of government regulation, Seth is an aggressive anti-cypherpunk and proud of it. (This is not to say that all cypherpunks are libertarians, of course. The DC cpunx are mostly Finkelsteinian leftists, as far as I can tell. But the problem is that modern leftism runs up against cypherpunkly thinking -- to the extent there is such a consensus -- pretty quickly.) -Declan

IRS Commercial Speech

Leen asked the judge to incorporate a First Amendment defense in instructions to the jury. But Tanner nixed that idea. He said he did not believe Bell was engaged in political speech. "Are the IRS laws political?" Tanner asked. "I thought they were passed by Congress and signed by the president." Tanner suggested the IRS was as apolitical as a highway "speed limit." "I'm going to deny those instructions," Tanner said, which means the jury will not consider the First Amendment implications of the charges against Bell. ***************** Declan, did anyone in court burst into hysterical laughter? I would have had a hard time restraining myself and would now be a guest of the Feds, I suppose. While it is true that trial courts hate 1A defenses and leave such things to the appeals courts, this is truly funny. Tanner is carving out a yet another "commercial speech" exception to the 1st arguing that mere government administration is not "political" and thus not open to full speech protection. He is certainly wrong. Actually, it's a great quote for the Appeals judges (if Jim gets around to appealing). I expect Jim to cave like he did the last time. No guts. DCF ---- "When confronted with persons of your ilk, my usual response is: Action Front! Load Triple Canister! Fire as they lay!" -- Canister. A cylindrical metal container filled with lead shot. Designed to turn a field artillery piece into a very large shotgun.

[note from an attorney, anonymized] Declan, I read your report of Day #5, shaking my head at the turn of events. Mr. Bell may be bright, he may have a mission, he may have a cause, he may have a point, but he is an excellent example of why one does not represent oneself in a trial. His attorney is between a rock and a hard place. Judge Tanner won't let him off the hook, and Bell won't let him do his job. Bell is doing a stunning job of giving the jury a reason to convict, and Judge Tanner keeps reeling out the rope so Bell can hang himself. It's sad. Bell is obviously disturbed. Is he insane? I don't know. But he exhibits no judgment whatsover in his defense, and he will pay a high price. I appreciate your coverage of the trial. My experience as a trial lawyer was you could count on the police and the newspaper to get the names correct, sometimes, and the newspaper to report only the most charged testimony or facts. Neither Mr. Bell nor I look forward to the outcome of his case. It's likely to be bad.
