The RIAA dropped its lawsuit against the sculptor who had a Mac and couldn't possibly have used Kazaa to download songs. http://www.cnn.com/2003/LAW/09/24/tech.lawsuit.ap/index.html So then I started thinkin'... But what if, say, I had a wireless access point on my cable or DSL modem setup and allowed friends and neighbors (maybe even warchalker strangers) to use it for whatever they chose? I certainly can't stop them from downloading music, I'm just allowing them to use my link. If I never downloaded songs or even had a host capable of running Kazaa, like this person, am I still off the hook? And if I'm responsible for that, wouldn't that make my ISP responsible too? I'm doing what they are doing, I'm just not taking names - I don't track who uses my WAP. Even if I just keep a list of wireless MAC addresses, that still doesn't really translate into anything of use to a prosecutor. If an open WAP means that the owner is subject to major criminal prosecution based on the behavior of the other people using it, then is there now an implicit requirement that all WAPs be secured, like a car or a gun? What are the legal responsibilities of a wireless access point owner/provider, and are people who own WAPs aware of them? If I implement the security protocols and someone breaks into my supposedly secure wireless network anyway, and is able to access bandwidth, am I still responsible for their downloads even if I implemented the standard precautions? Or is it like a swimming pool, an "attractive nuisance", for which the swimming pool owner is responsible for the drowning of neighborhood children even though he puts a six foot fence around it? A full list of changes since the 0.4.1.3 release can be found online [1], but there are two major modifications, one good and one bad: The good one is that we've dramatically cut down on the memory churn caused by all sorts of insane temporary object creation. I finally got fed up with watching the GC go mad while debugging the new streaming lib, so after a few days of profiling, tweaking, and tuning, the ugliest parts are cleaned up. The bad one is a bugfix for how some tunnel routed messages are handled - there were some situations where a message was sent directly to the targeted router rather than tunnel routed prior to delivery, which could be exploited by an adversary who can do a little coding. We now properly tunnel route when in doubt. That may sound good, but the 'bad' part is that it means that there's going to be some increased latency due to the additional hops, though these are hops that needed to be used anyway. There are other debugging activities going on in the core as well, so there hasn't been an official release yet - CVS HEAD is 0.4.1.3-8. In the next few days we'll probably have a 0.4.1.4 release, just to get all that stuff cleared up. It won't contain the new streaming lib, of course. There's a cut in SWM4 *SMW4 Segment 4.1 cable fault* Cable shunt fault developed on SMW4 segment 4.1 (Egypt / Alexandria b Branching Unit #4A onward France / Marseilles) at 07:15GMT on 14-Apr. 2010. However the shunt fault has further deteriorated and the cable segment was down at 10:03GMT. Only four unprotected Singapore b London / Frankfurt STM-4c IP trunks were being affected. SMW4 NOC updated that there is a shunt fault in segment 4.1 between Egypt / Alexandria and France / Marseilles with cable fault on Fiber Pair #2 at 1886.152 km from Alexandria towards Palermo. The traffic landed at Palermo onwards to Europe was being affected, while the traffic running between Alexandria and Marseilles via Fiber Pair #1 is still maintained.
