No civil rights in NatSec domain
by coderman 13 Apr '19

13 Apr '19

during the case with Roark, the government also surveilled communications and interfered with legal proceedings. NatSec cases give no regard to civil rights in legal process. constitutionality is a myth, no longer given fig leaf treatment. --- https://www.theregister.co.uk/2019/04/11/cia_vault_7/ Client-attorney privilege? Not when you're accused of leaking Vault 7 CIA code Lawyer for Joshua Schulte unhappy about agency review By [Kieren McCarthy in San Francisco](https://www.theregister.co.uk/Author/Kieren-McCarthy) 11 Apr 2019 at 22:05 The lawyer for former CIA employee Joshua Schulte is unhappy the spy agency is allowed to review communications with her client before she receives it and has accused the agency of trying to intimidate her. Schulte's lawyer, Sabrina Shroff, appeared in a New York court on Wednesday and argued that the CIA was abusing client-attorney privilege as well as threatening her with future legal repercussions for receiving confidential material. "The CIA essentially has threatened us,” Shroff told the judge. Asked whether the spy agency was also listening in on her confidential conversations with her client, she responded: "We don't know." The CIA [believes](https://www.theregister.co.uk/2018/05/15/vault_7_leak/) that Schulte was behind a [massive leak](https://www.theregister.co.uk/2017/03/23/wikileaks_cia_darkmatter_vault_7/) of material from the spy agency that outlined how it is able to install spy software on laptops and phones. But it has been unable to prove the assertion. Schulte is currently in jail on unrelated charges of possession and distribution of child abuse images but the CIA has made it plain he is the prime suspect in the information leak. Schulte was in charge of a server that contained 54GB of illegal content but has pled not guilty, arguing that he was running a public server and had no idea about the images. Thanks to his work for the CIA's engineering development group and the spy agency's suspicions that he was behind the leak, he and his lawyer have been put under extreme restrictions. Schulte's lawyer has to make a request to meet with him one week prior to any meeting. He is then transferred to a special secure area that is monitored by CCTV before being strip-searched and chained to the floor. His lawyer is not allowed to take in any equipment and must use a government-supplied computer to review any material – conditions [imposed](https://regmedia.co.uk/2019/04/11/schulte-conditions.pdf) [PDF] by the judge. But despite specific provisions that prevent jail staff from recording any audio or sharing any information with the prosecution, Shroff suspects the CIA is monitoring her meetings regardless. Delay tactics She is also frustrated that the court ordered that any material produced by Schulte is first reviewed by the CIA before it is supplied to her, and that the agency seems to be going out of its way to delay access, as well as frustrate her efforts to provide him with a defense. "We are experiencing significant delay in the CIA's process of classifying our client’s work product," she [wrote](https://regmedia.co.uk/2019/04/11/schulte-delay.pdf) [PDF] to the judge in March, giving the example of one document that had taken more than two weeks to be cleared. "We ask that the Court impose reasonable deadlines by which time the CIA walled individual must respond to documents given to him for classification review." She argued for a 10-day maximum. The government [responded](https://regmedia.co.uk/2019/04/11/cia-schulte-no-control.pdf) [PDF] saying that it had no way to speed up the process because the CIA officer in charge of reviewing the material is independent from its prosecutorial team. In court on Wednesday, the government even argued that the CIA was a "victim" in the whole process, facing criticism for doing its job of protecting national security secrets. Shroff made her disagreement known. Prior to the court hearing, Shroff repeatedly informed the judge that the CIA was hindering her work "because the CIA insists that all of his written communications with counsel - down to each comment or proposed edit to any work product - must be reviewed and cleared in advance by the 'walled' CIA employee." The walled employee has also failed to sign a Memorandum of Understanding, she [complained](https://regmedia.co.uk/2019/04/11/schulte-mou-delay.pdf) [PDF], by "insisting on continued edits to standard language." Schoff argued for restrictions surrounding the search warrants lodged against her client two years earlier be lifted because they have contained no confidential information. In reply, the government [argued](https://regmedia.co.uk/2019/04/11/schulte-cia-search-warrants.pdf) [PDF] that Schulte and his lawyer had broken an earlier agreement not to share any information in the case, accusing them of providing information to the press. Thanks to the CIA-imposed delays, the judge delayed the start date of the trial – which was due to begin on April 8 – and instead ordered a joint conference yesterday, April 10. Here's a solution After Schoff outlined her frustrations at that hearing, the New York attorney prosecuting Schulte for the child abuse images charge suggested that one of his lawyers be used to review communications instead of the CIA employee, in order to speed things up. Schoff argued that that process would make it even easier for the CIA to break client-attorney privilege. "I want to have an open attorney-client relationship with Mr Schulte just like I do with everyone else," she pleaded with the judge. "We don't want to have Mr Schulte's documents read by the CIA at all," she told the hearing according to a [report](https://www.law360.com/cybersecurity-privacy/articles/1148778/cia-r… from Law360. It's unclear how the judge will ultimately decide – or whether that decision will even be made public since the entire case is under a special protective order. The judge could simply order that the two cases – the child abuse images case and the CIA leak case – be separated. But then, of course, that would limit the CIA's ability to make Schulte's life a misery.

Hackers publish information on thousands of US police officers and federal agents
by jim bell 13 Apr '19

13 Apr '19

https://techcrunch.com/2019/04/12/police-data-hack/ [partial quote follows.] "A hacker group has breached several FBI-affiliated websites and uploaded their contents to the web, including dozens of files containing the personal information of thousands of federal agents and law enforcement officers, TechCrunch has learned. "The hackers breached three sites associated with the FBI National Academy Association, a coalition of different chapters across the U.S. promoting federal and law enforcement leadership and training located at the FBI training academy in Quantico, VA. The hackers exploited flaws on at least three of the organization’s chapter websites — which we’re not naming — and downloaded the contents of each web server. "The hackers then put the data up for download on their own website, which we’re also not naming nor linking to given the sensitivity of the data. "The spreadsheets contained about 4,000 unique records after duplicates were removed, including member names, a mix of personal and government email addresses, job titles, phone numbers and their postal addresses. The FBINAA could not be reached for comment outside of business hours. If we hear back, we’ll update. "TechCrunch spoke to one of the hackers, who didn’t identify his or her name, through an encrypted chat late Friday. “We hacked more than 1,000 sites,” said the hacker. “Now we are structuring all the data, and soon they will be sold. I think something else will publish from the list of hacked government sites.” We asked if the hacker was worried that the files they put up for download would put federal agents and law enforcement at risk. “Probably, yes,” the hacker said. "The hacker claimed to have “over a million data” [sic] on employees across several U.S. federal agencies and public service organizations. [end partial quote]

Re: [tor-talk] tor project website change
by grarpamp 13 Apr '19

13 Apr '19

> global adversaries > "they don't likely exist, or if they do, they're our friends" Highly capable Global Adversaries are well known to exist. TOP SECRET friends may perhaps be the friends of few, often end up generally corruptive, less than stellar, an uncertainty, etc... thus really shouldn't be kept or created. Seek out better ways. > implementing one of the newer designs seems unlikely. > Given that potential volunteers are working on Tor. That's another problem with large projects, like corporate and government monopolies, they can suck up all the air in the room... needed and valuable diversity, competition, and evolution gets starved out, groupthink herd monoculture etc sets in generations. In the space of critical use case anonymity, privacy, messaging tools, crypto utility application overlay networks, cryptocurrency, etc... a space too new to have enough breadth and depth of research paths dreamed up and exhausted so as to begin to see what works, to advise with confidence, or not... that would not be good at all. Tor... circuit based encrypted onion routing tcp with quasi decentral human roots of authority... is a done architecture model since 20 years, its wholesale novel development research covered in its early whitepapers. Researchers hoping for big architecture breakthroughs against adversaries, should probably investigate other potential and new solutions elsewhere. Even if only filling in currently uncovered use cases, on up to addressing current and expected evolution in adversaries, there is a lot of fun work to do out there beyond Tor. As for Tor, there is much left... tickets, UI, Web, Phone, optimization, obfuscation, their own "community", waging part in the overall pro privacy freedom speech crypto war, all sorts of research, improvements, and publication on how its network architecture is doing in vivo, where it's useful and not, ongoing operations... the long tail of Tor, same as any project. Tor gets so much money some said Tor could throw a bunch of it into an independant overlay competition fund. But since such parent child separation is not achievable, it is the donors who would need to start that up on their own, and the newer diverse projects who can consider accepting it. Like any other project, Tor is great at what it does well, yet those areas are *not* unlimited. This is not Kansas, it's Overlay Land, a land known to be considered for use by those with more critical / different needs than say, simply browsing the web. [Even then...] Tor users should see more disclaimer and fair honest analysis, and less blanket use case superlative coming from Tor. Indeed sad to whatever extent that does not happen.
