Litigation Funding Proves its Value in UK Post Office Scandal - Litigation Finance Journal

Last week, 30 criminal convictions were vacated in an action that would not have proceeded were it not for third-party legal funding. And make no mistake—that would have been a grave injustice. Financial Times <https://www.ft.com/content/0d1125ba-564f-4876-8ae7-151779bdb367> details that decades of injustice befell sub-postmasters in the UK when errors in the Post Office IT system led to accusations of widespread misappropriation of funds and false accounting. Not surprisingly, this in turn, led to ruined lives and livelihoods. These sub-postmasters were clearly wronged but lacked the means to pursue a case. Paula Vennells, former post office chief executive, refused to consider that the Horizon accounting system was to blame, and fought fiercely to drag out litigation meant to clear the names of hundreds of wronged employees. Those employees eventually received help from Therium, a third-party legal funder. Therium funded the case on a non-recourse basis, which eventually resulted in a settlement of GBP 58 million. After costs and Therium taking their share, claimants will split the remaining GBP 12 million. It may seem like the funders get the lion’s share of the settlement. Consider though, that funders take the most financial risk. The non-recourse nature of funding necessitates a higher payout, because if the case had not resulted in a payout, Therium’s investment would be a total loss. What we see in this case are ordinary citizens wronged by a corrupt system, seeing their day in court, and being compensated—thanks to Litigation Finance.

The story goes: When the Horizon computer system found over 736 sub-postmasters were allegedly grifting from the United Kingdom’s postal budgets, they were summarily punished. However, Horizon’s back office capabilities were later found to contain bugs and other system defects that allegedly found workers at fault by mistake. Enter litigation funding, a utility that many of the former post office workers found necessary to clear their name. According to the Law Society of Scotland <https://www.lawscot.org.uk/members/journal/issues/vol-67-issue-05/litigatio…>, February of 2022 saw the initiation of a public debate and investigation on the totality of the Post Office scandal’s effects. The whole affair is being dubbed an extreme case of United Kingdom justice malfeasance. Furthermore, the Law Society explains that about 10% of the 736 criminal records have been overturned. A class of 555 claimants have won restitution, totaling £20,000 each. For Moxie, it sounds like having to ‘rediscover’ your contacts periodically at any point is a horrible inconvenience. For anarchists, it should be considered an advantage to have to intentionally maintain our ‘social graph’ based on our affinity, desires, and trust. Who is in our ‘social graph’ should be something we are constantly reevaluating and reexamining for security reasons (do I still trust everyone who has my phone number from 10 years ago) and to encourage intentional social relationships (am I still friends with everyone who has by phone number from 10 years ago). It’s for NeurIPS 2022, upcoming. I’ve been kicking it around in my mind a smidge, and I’m thinking it would just be so useful and likely appreciated for anybody at all to make any implementation at all of this paper, that it would be worth trying to do. The concept of the paper is not complex, but it’s quite hard for me to approach, as usual.
