Fwd: FDIC Proposed Rule on Brokered Deposits is Unwarranted

Brokered deposits are funds collected by a broker from multiple customers and deposited into a bank. As financial institutions navigate market challenges, brokered deposits play a vital role in diversifying funding sources and enhancing overall stability. In 2020, the FDIC significantly modernized its brokered deposits regulations following a multi-year comment period. If adopted, the proposed rule would reverse recently established policy without adequate reasoning or justification, potentially destabilizing the brokered deposit marketplace and creating unnecessary costs to the economy. In a letter to the FDIC, the Forum stated that reversing existing rules would disrupt long-established arrangements. The proposed rule would impose significant costs to the banking sector, including the U.S. Global Systemically Important Banks, which are subject to the most stringent prudential requirements. That would ultimately result in higher costs for consumers and businesses and act as a drag on the economy as a whole. “This rapid reversal of existing regulatory practices would impede the practice of safe and sound banking by reducing consistency and transparency surrounding the FDIC’s expectations,” Forum President and CEO Kevin Fromer said. “The FDIC should not engage in such a broad rulemaking that would unnecessarily destabilize its own recently settled approach without first understanding the potential costs and benefits of the Proposal.” The Forum’s full letter can be found here <https://financialservicesforum.cmail19.com/t/r-l-tduihttd-njyjukhihy-y/>. Matt Gaetz Case Has Echoes of the Justice Department’s Failure to Prosecute Jeffrey Epstein’s Sex-Trafficking Ring
by Gunnar Larson 21 Nov '24

21 Nov '24

https://wallstreetonparade.com/2024/11/matt-gaetz-case-has-echoes-of-the-ju… By Pam Martens and Russ Martens: November 21, 2024 ~ Jeffrey Epstein Jeffrey Epstein Today’s New York Times carries a diagram prepared by the U.S. Department of Justice during its multi-year investigation into then Congressman Matt Gaetz. (We have printed the left-hand section of the diagram above.) The diagram illustrates the following about the DOJ’s investigation into the man that President-elect Donald Trump wants to install as the U.S. Attorney General – the top law enforcement officer at the U.S. Department of Justice: The DOJ had receipts for the money flows between Matt Gaetz and the women he was paying for sex and the other individuals involved in the related sex and drug parties from 2017 to 2020. The public also learned this past week from the attorney, Joel Leppard, who represented two of the young women who were paid for sex with Gaetz – that the DOJ had interviewed at least a dozen of the women whom Gaetz had paid for sex. These women are indicated on the diagram published by The Times with the dollar amounts paid. Leppard explained to ABC News what motivated the young women to have sex with Gaetz and others at the parties: “Leppard said his clients — one of whom was a [high school] student at the time — decided to attend the parties where they had sex with Gaetz and others in order to make enough money to pay rent. ” ‘It was that kind of situation where they’re literally, Hey, I got to make rent this month. Let’s go out and go to some of these events,’ and ‘Here’s how we’re going to pay rent.’ “ Despite sweeping evidence, payment receipts, depositions from at least a dozen witnesses, and testimony from a cooperating witness in the sex ring, Joel Greenberg, the DOJ failed to bring a single charge against then Congressman Matt Gaetz. That inaction came despite the fact that prostitution is illegal in all U.S. states with the exception of some counties in Nevada. More importantly, a sitting member of Congress or the Executive Branch is viewed as being vulnerable to blackmail when they are hiding a history of crime. To understand the DOJ’s timidity to go after Gaetz requires a broader understanding of how the DOJ has become compromised and intimidated by powerful people and their high-priced lawyers. There are strong echoes in the Gaetz matter to how the Justice Department let Jeffrey Epstein off the hook in 2008 for sex-trafficking of dozens of underage high school girls despite a mountain of evidence and depositions compiled by the Palm Beach County police in Florida. The U.S. Department of Justice cut a deal that allowed Epstein to serve just 13 months in jail from June 2008 to July 2009 – the majority of the time in a work release program where Epstein was driven to an office each day by his personal chauffeur. Following the work release program, Epstein was required to spend one year under house arrest at his Palm Beach residence. But in a documentary series on Epstein, Filthy Rich, based on the nonfiction book by the same name, a Palm Beach police official explained what actually happened: “He would violate his probation almost on a daily basis. There’s 11 pages here of just different violations. I think, I, myself, documented 66 different days that he violated his probation…He would go to New York, to his island, he would go to the airport, jump in his helicopter. Who knows where he went – without telling anybody. Every time I brought the probation office a case, they kept telling me the same thing. What would you like us to do? He’s a celebrity. I mean, just think about this: You have a pedophile out on probation – to violate probation in the state of Florida is illegal, except for Jeffrey Epstein.” Despite having videotaped testimony from Epstein’s victims and statements confirming the abuse from a multitude of other witnesses, the U.S. Department of Justice allowed this pedophile to remain free – traveling throughout the United States and around the world on his private jets – sexually abusing girls and young women at his multiple mansions for another decade, until his arrest on July 6, 2019 on federal sex trafficking charges. Epstein died in a Manhattan jail on August 10, 2019 – just a little more than a month after his arrest. The New York City Medical Examiner ruled his death a suicide. The Department of Justice was likely shamed into finally taking serious action against Epstein in 2019 by reporter Julie Brown’s explosive series on Epstein’s sex crimes that appeared in the Miami Herald newspaper in November 2018. Wall Street On Parade’s detailed coverage of the Epstein case has centered on the fact that the largest federally-insured bank in the United States, JPMorgan Chase, was supplying Epstein with the tens of thousands of dollars in hard cash each month to pay off his victims as well as the young women he hired to recruit more school girls that he could sexually abuse or pimp out to his ultra-wealthy friends. But notwithstanding the fact that JPMorgan Chase has a rap sheet that rivals that of an organized crime family, including five criminal felony counts, the U.S. Department of Justice has yet to bring a criminal case against the bank for aiding and abetting Epstein in his crimes – despite a mountain of detailed evidence developed by the Attorney General of the U.S. Virgin Islands, where Epstein owned his own so-called “Pedophile Island” and treated himself and his rich pals to sexually abusing young girls within the isolated confines of his tropical paradise. The federal lawsuit filed by the Attorney General of the U.S. Virgin Islands alleged that JPMorgan Chase had “actively participated” in Epstein’s sex trafficking. A Memorandum of Law arguing for partial summary judgment in the case, that was filed by the Attorney General for the U.S. Virgin Islands, makes the following points: “Even if participation requires active engagement…there is no genuine dispute that JPMorgan actively participated in Epstein’s sex-trafficking venture from 2006 until 2019. The Court found allegations that the Bank allowed Epstein to use its accounts to send dozens of payments to then-known co-conspirators [redacted] provided excessive and unusual amounts of cash to Epstein; and structured cash withdrawals so that those withdrawals would not appear suspicious ‘went well beyond merely providing their usual [banking] services to Jeffrey Epstein and his affiliated entities’ and were sufficient to allege active engagement.” The U.S. Virgin Islands had previously advised the court on the unfathomable sums of hard cash that Epstein was able to take from the accounts he maintained at JPMorgan Chase without the bank filing the legally mandated Suspicious Activity Reports (SARs) to law enforcement. In the Memorandum linked above, it tallied up the giant pile of cash, writing as follows: “Between September 2003 and November 2013, or approximately ten years, JPMorgan handled more than $5 million in outgoing cash transactions for Epstein — ignoring its own policy discouraging large cash withdrawals….” The U.S. Virgin Islands’ attorneys cited to internal emails at JPMorgan Chase showing that employees at the bank were aware of Epstein’s “[c]ash withdrawals … made in amounts for $40,000 to $80,000 several times a month” while also being aware that Epstein paid his underage sexual assault victims in cash. After a scorched earth campaign by JPMorgan Chase’s attorneys to humiliate the U.S. Virgin Islands in the media over its own unseemly political ties to Epstein, the case was settled, with JPMorgan Chase paying the U.S. Virgin Islands $75 million. JPMorgan Chase’s involvement in the Epstein sex trafficking ring was also alleged in a class action lawsuit against JPMorgan Chase brought by lawyers David Boies and Bradley Edwards on behalf of Epstein’s victims. At a March 13, 2023 court hearing in the case, Boies argued in open court that JPMorgan Chase had used a private jet owned by the bank’s hedge fund, Highbridge Capital, to transport girls for Epstein’s sex trafficking operation. With the criminal division of the U.S. Department of Justice still failing to take action against JPMorgan Chase for its alleged money laundering for Epstein, and the Boies/Edwards lawsuit on behalf of victims now settled for $290 million by JPMorgan Chase – with victims’ lawyers getting $87 million in legal fees and $2.5 million in expenses while victims are guaranteed nothing other than a requirement to release their claims – there is little hope that the American people will ever see sunshine in this matter. According to court filings in the Epstein/JPMorgan Chase cases, Epstein was running a “sex-themed cult.” According to a deposition of a JPMorgan banker, the only money-generating business that Epstein had was tending to his “network.” According to witness testimony, fulfilling the sexual fantasies of powerful men in Epstein’s “network,” was how he obtained six opulent homes and hundreds of millions of dollars in wealth. The information available to the public thus far suggests that Matt Gaetz, nominee to head the most powerful federal law enforcement agency in the U.S., was also running a sex/drug themed party circuit for himself and unnamed men – the black top hats in the diagram above — and the U.S. Department of Justice failed to bring charges against Gaetz. It’s long past the time for an independent investigation into the compromised U.S. Department of Justice. The Silk Road Investigation: A 'Pattern of Bad Behavior and Double Agents' ? Bitcoin News
by Gunnar Larson 21 Nov '24

21 Nov '24

Whete is Kathryn Haun when you need her on NYCCoin? ..... https://news.bitcoin.com/the-silk-road-investigation-a-pattern-of-bad-behav… by Jamie Redman Oct 22, 2019 The Silk Road Investigation: A 'Pattern of Bad Behavior and Double Agents' The Silk Road Investigation: A 'Pattern of Bad Behavior and Double Agents' Kathryn Haun, a general partner at U.S. venture capital firm Andreessen Horowitz, has revealed in recent interviews how she helped take down the Silk Road when she was working for the Attorney General’s office. According to her accounts, the U.S. government agency also asked her to help “start shutting down technology before it’s built.” Haun’s story also highlights how the U.S. government’s evidence against the Silk Road transpired because of double agents. Also read: FBI Agent Admits to Stealing Silk Road Bitcoins Seized by U.S. Marshals Kathryn Haun Was Asked to Disrupt Bitcoin in 2012 During the last few years, governments worldwide have been cracking down on digital assets like on and off-ramps that are tied to fiat. Regulations are far stricter than they were in the early days, when governments first heard about cryptocurrencies like bitcoin. Andreessen Horowitz general partner Kathryn Haun has a lot of experience working with government agencies when it comes to the cryptocurrency economy. She witnessed the takedown of the Silk Road darknet marketplace and before she started she was even asked to help dismantle the Bitcoin network. During an interview with CNBC, Haun revealed how a colleague mentioned the up and coming technology to her in 2012. “‘We have this perfect assignment for you – there’s this thing called Bitcoin and we need to investigate it,'” Haun told the news outlet on October 6. “That was the first time I’d ever heard of bitcoin,” she added. The Silk Road Investigation: A 'Pattern of Bad Behavior and Double Agents' Former Silk Road investigator Kathryn Haun. Attempts to shut down Bitcoin by agencies such as the U.S. Department of Justice were fruitless ventures, Haun detailed. “It would have been akin to saying ‘let’s go prosecute cash,'” the former prosecutor said. “What we heard with Libra were the same criticisms [about Bitcoin],” Haun remarked. While discussing the similarities between her early days with Bitcoin in contrast to Libra, she continued: They got more attention because of the high-profile nature of the project and the fact that Facebook was involved. I think it would be a really dangerous thing, and frankly a dangerous precedent to start shutting down technology before it’s built. Uncovering the Silk Road and Parallel Investigations During another recently published interview with Haun, the Andreesen Horowitz partner spoke with Hayman Capital founder Kyle Bass about her role during the prosecution of the Silk Road marketplace. “The Silk Road was making millions of dollars a month and they were generating a lot of revenue,” Haun stressed. She doesn’t remember exactly how the Silk Road case got opened in New York, but she recalls Senator Chuck Schumer read a Wired article that prompted him to wonder why the marketplace was allowed to exist. “So the Southern District of New York, which is another Attorney General’s office – I was in the U.S. Attorney General’s office in San Francisco – SDNY opened the case and was trying to figure out who was behind the Silk Road. At this same time, a D.C. office was also trying to figure out who was running the Silk Road — And there were parallel investigations going.” The Silk Road Investigation: A 'Pattern of Bad Behavior and Double Agents' Haun discusses the Silk Road investigation with Hayman Capital founder Kyle Bass. Haun explained that the government had task forces comprised of many alphabet soup agencies: “We’re talking the FBI, CIA, Secret Service, DEA, ATF, and the U.S. Marshals,” she underlined. “One task force, the one out of Washington D.C., they had an undercover agent. That undercover agent was able to befriend the person running the Silk Road. All the government knew at the time was that the person running the Silk Road went by the nickname ‘DPR’ for ‘Dread Pirate Roberts’ from the movie ‘The Princess Bride.’ So they didn’t know who DPR was, but the undercover agent actually set up an attempt to buy the Silk Road.” The Foundation of Evidence from the Silk Road Case Stemmed from Double Agents According to the former prosecutor, the undercover agent struck many online conversations with DPR and proceeded for the next two years to engage and message with the moniker. “A lot of things went wrong on both sides — From the Silk Road side, 2013 was a really bad year for the Silk Road because what you had was a person who had an online persona called ‘Death from Above,’” Haun said. “Death from Above starting extorting DPR and saying ‘if you don’t pay me hundreds of thousands of dollars in bitcoin I’m going to reveal your identity to law enforcement.’ Meanwhile, there was another online persona who went by the moniker ‘French Maid.’ French Maid was selling DPR information about the government’s investigation. French Maid told DPR the Feds are closing in and the end is near and you are about to be had.” Haun added: The government didn’t know any of this then and it all came out after the fact. In the midst of this, something else really bad happened in 2013 — About 21,000 bitcoins, which is today in excess of roughly $150 million dollars, went missing overnight from the Silk Road. From Silk Road vendor accounts and from what you might consider the petty cash account — Although there’s nothing petty about 21,000 bitcoins. The Silk Road Investigation: A 'Pattern of Bad Behavior and Double Agents' Haun’s story begs the question: How much evidence would the government have without the use of double agents and rogue officers manipulating the investigation? During the remainder of the interview, Haun discussed Curtis Green’s role with the Silk Road and said Green showed the Feds “how the Silk Road worked, how to log into it, how to reset vendor PINs and passwords, and of course [Green] had that access because he was the key administrator.” Haun also said Green even gave his laptop to the Feds to keep as evidence. The discussion with Kyle Bass shows how government agents claim to have dismantled the Silk Road from the words of a former Federal prosecutor. However, Haun wasn’t involved with the DPR takedown first hand, but she was very much involved with investigating rogue agents. At first, when she heard about the first rogue agent she took it with “a grain of salt” and actually said it was a shame the tipster was smearing a Federal agent’s good name. But the tipster was insistent and she decided to look into it. “We saw that this agent who we got the tip for was liquidating hundreds of thousands of dollars, if not millions a month, in cryptocurrency. So I thought it’s probably another undercover operation and there’s probably a legitimate explanation,” Haun explained. The Silk Road Investigation: A 'Pattern of Bad Behavior and Double Agents' >From left to right — Carl Mark Force, Shaun Bridges, and Curtis Green all played a ‘double agent’ role in the Silk Road investigation. Curtis Green was a Silk Road moderator who was told by the U.S. government to fake his own death. Haun concluded that the rogue agent was caught telling exchanges to destroy transaction histories. Because undercover agents who are running undercover operations shouldn’t be asking for evidence to be destroyed, it raised a red flag Haun said. Her team found a “pattern of really bad behavior to put it mildly” and in the end, it turned out the rogue agent was both online personas: French Maid and Death from Above. Essentially, the interview with Haun shows that Curtis Green, Shaun Bridges, and Carl Mark Force were acting as double agents during the entire investigation. The discussion with Haun further highlights how the Silk Road case was quite messy and many constitutional laws were broken by rogue agents in order to disrupt the site. Still, the U.S. government, with no thought toward constitutional law and a complete disregard for true justice, based all their Silk Road evidence on the shameful ethics of Curtis Green and two rogue cops — Carl Mark Force and Shaun Bridges. It goes to show that the many unanswered questions surrounding the case, like how government agents found the Silk Road’s IP address, which wasn’t due to a faulty ‘captcha’ screen as claimed, were likely due to perfidious agents gone rogue.
