Ferencz describes his personal experiences and conclusions over more than half a century trying to replace the law of force by the force of law. As part of a comprehensive historical review, he describes the little-known trials by military commissions that preceded the International Military Tribunal and the dozen subsequent trials at Nuremberg where other leading perpetrators were held accountable. Ferencz describes the unprecedented efforts thereafter to obtain restitution and compensation for victims. Deterring illegal war-making -- the crime of aggression -- became his primary goal and produced many scholarly books and countless articles. His lectures around the world in support of the International Criminal Court and his determined optimism remain a continuing inspiration.

UN court hears South Africa genocide case against Israel - BBC News

https://www.bbc.com/news/world-middle-east-67942983 The UN's International Court of Justice is hearing a case brought by South Africa accusing Israel of committing genocide against Palestinians in Gaza. The submission also calls on the court to order Israel to stop military operations there. The ICJ will deliver only an opinion on the genocide allegation as the case is not a criminal trial, although it is being closely watched. Israel has vehemently rejected the accusation as "baseless". There were angry scenes outside the ICJ's Peace Palace on Thursday as Dutch police struggled to keep groups of Palestinian and Israeli supporters apart. Hundreds of people waving Palestinian flags gathered outside the ICJ, calling for a ceasefire. Israeli supporters set up a screen showing images of some of the hostages still being held in Gaza. Pro-Palestinian protests also took place in Cape Town, South Africa. South Africa will present its case on Thursday and Israel its defence on Friday. In its submission, South Africa says Israel's actions "are intended to bring about the destruction of a substantial part of the Palestinian national, racial and ethnical group". It says Israel's actions include "killing Palestinians in Gaza, causing them serious bodily and mental harm, and inflicting on them conditions of life calculated to bring about their physical destruction". It calls for "provisional measures" to be implemented by the court as a matter of urgency, including that Israel cease all military activities in Gaza. Israel has defended its actions in Gaza, saying it is responding to Hamas's deadly attacks on 7 October, but speaking in court on Thursday, South Africa's Justice Minister Ronald Lamola said no attack "can provide justification for or defend breaches of the [Genocide] Convention". Israel is a signatory to the Genocide Convention of 1948, which defines genocide and commits states to prevent it. The ICJ is the UN's top court, based in the Hague in the Netherlands. Its rulings are theoretically legally binding on parties to the ICJ - which include Israel and South Africa - but are not enforceable. In 2022, the court ordered Russia to "immediately suspend military operations" in Ukraine, an order that was ignored. Under international law, genocide is defined as committing one or more acts with the intention to destroy, in whole or in part, a national, ethnic, racial or religious group. Red and white police tape has been placed outside the Peace Palace - as the ICJ building is called - in an attempt to bring some semblance of order to the chaotic scenes outside. It is in contrast to the formality inside the court, where the Israeli delegation is listening to South Africa's lawyers accuse the country's forces of committing genocide in Gaza. Israel denies this, and on Friday will have a chance to respond. Its delegation is expected to highlight its right to self-defence under international law - this week, Prime Minister Benjamin Netanyahu said Israel has no intention of permanently displacing the people of Gaza, or occupying the territory.

The 'Hotel California' Wealth Tax Advances, You Cannot Leave To Escape It Authored by Mike Shedlock via MishTalk.com, The California legislature takes up the wealth tax idea this week. It’s a Hotel California doozie... California’s Wealth Tax in the Batter’s Box The Wall Street Journal reports California’s Wealth Tax Arrives. It hasn’t yet, but it’s in the batter’s box. Democrats introduced the bill last winter, and it will get a hearing Wednesday in the state Assembly as lawmakers scrounge for revenue to fill a projected $68 billion budget hole. Gov. Gavin Newsom on Wednesday will also unveil his budget for the coming year. Democratic legislators are proposing a wealth tax as an alternative to spending restraint. Wealth Tax Details The bill would impose an annual excise tax of 1.5% on the worldwide net worth of every full- and part-year California resident that exceeds $1 billion, starting this tax year. Come Jan. 1, 2026, the state would tax wealth that exceeds $50 million at a rate of 1% each year, with an additional 0.5% tax on assets valued at more than $1 billion. Part-time residents would be taxed on a pro rata share of their wealth based on the number of days they spend annually in California. The tax would also apply to nonresidents who have recently left the state. Democrats exempted real property from the tax as a favor to their high-end real-estate industry and Hollywood donors. To spread the wealth around to plaintiff-bar donors, the bill would apply the state’s False Claims Act to wealth-tax records and statements. This means plaintiff attorneys could sue affluent individuals on behalf of the state for allegedly under-reporting assets. Plaintiff attorneys would be entitled to a share of the state’s recovery. Constitutionality I highly doubt this is constitutional and I am certain that taxing people who don’t live in the state isn’t. But no one gives a damn about such things anymore. If this passes, there will be an accelerated exodus from the state. Won’t that be fun. Instead it eliminated the entire reparations office. Governor Newsom faces some tough economic and political choices. Apparently the no-so-tough choice is to raise taxes even on people who flee the state to avoid them. If this passes, the Supreme Court will strike it down. Get the hell out of California anyway. Other tax hikes are sure to come.

If Democrats want to change the law so that any misdemeanor arrest prevents gun purchases, this would at least be related to the Charleston case. But Democrats want to impose up to a 30-day waiting period without explicitly stating that is their real aim. If they want a long waiting period, they should make a case for why this would somehow be desirable. Instead, Democrats pretend that their proposal would have stopped the Charleston shooting when their actual goal is to obtain a long waiting period. Biden said that gunmakers are “exempt from being sued. ... This is the only outfit that is exempt from being sued.” The president claims this is the top change he wants. In fact, however, if gunmakers make defective guns, you can sue them. Likewise, if they break the law (e.g., sell a firearm without a background check), you can sue them. Biden’s proposal is very different from current law. He wants gun manufacturers held civilly liable for misuse of guns they sell. This would allow lawsuits against manufacturers and sellers whenever a crime, accident, or suicide occurs with a gun. The straightforward result would be to put gunmakers out of business. Imagine what would happen to the car industry if similar rules were applied. The National Safety Council estimates that 39,404 Americans died and 4.5 million were injured from car accidents in 2018. Cars are also frequently used to commit crimes. “The vast majority of Americans believe there should be [universal] background checks.” Gun control advocates frequently claim that over 90% of Americans support background checks for private transfers of guns. Yet, the last time such laws were proposed to voters, they rejected them. When Michael Bloomberg got universal background check initiatives onto Maine and Nevada’s ballots, for example, he lost in Maine by four percentage points and won in Nevada by just 0.8 percentage points. This tough sledding wasn’t for lack of money. In Maine, Bloomberg outspent his opponents by over six times. In Nevada, he spent an incredible $35.30 per vote — three times more than his opponents. If over 90% of Americans supported these laws, this type of spending would be unnecessary. He blamed the “historic spike in homicides” on the lack of gun control laws. No sudden change in gun control laws caused last year’s spike in homicides. Instead, the real explanation is simple, and something Biden refused to consider: prisons released a large number of inmates because of COVID-19, politicians ordered police to stand down, police department budgets were cut, and prosecutors refused to prosecute criminals. In describing mass public shootings, Biden said that gun violence in this country is an “international embarrassment.” The president might not follow international news closely, but mass public shootings are much more common and deadly in the rest of the world than they are in the United States. The U.S. contains 4.6% of the world’s population, yet accounts for only 1% of the world’s shooters. Over the last decade, Europe has experienced deadlier mass public shootings than any of those in the U.S. -- ever. In November 2015, for example, 130 people were shot to death at a concert in Paris. In July 2011, 67 people were shot to death in Norway. European countries such as France, Finland, Norway, and a number of Eastern European countries have higher per capita death rates from mass public shootings than the United States does. Yet, all of these countries have stricter gun control laws than we do. These are just a few of the false claims made on Thursday. No, the rules for buying guns at gun shows are no different than buying them anywhere else. And no, when guns are unavailable neither the suicides nor the suicide attempts drop. To help finance the needs of children, UNICEF and UNDP are developing a Child Bond Standard, that will cover the areas of education, health, nutrition, water, sanitation and hygiene. The standard will facilitate the issuance of child bonds, as well as serve as a way for financial markets and bond verifiers to measure a bond’s impact on children. More than 40 per cent of the world’s population is under the age of 25. Meeting their needs is crucial to achieving the Sustainable Development Goals (SDGs). Although many socially responsible corporations and financial institutions have started aligning their activities with the SDGs, children’s rights are often not integrated into business activities and there are large financing gaps. There is a need for financial instruments and commonly accepted methodologies that both mobilize financing for children and measure the impacts of such investments on children and young people. The Child Bond Standard will include a catalogue to identify and screen projects, measures to evaluate and rate them, metrics to assess their impacts, and principles to conduct information disclosure. The standard is intended to be global, and it will be tested in developing economies initially and rolled out worldwide. The standard will be used in project design to ensure a child-focused approach will be adopted, and after project implementation to measure whether there is a positive and lasting impact on children. UNICEF and UNDP are not going to issue or verify bonds; they are producing an industry standard for issuers and verifiers. The project will draw on experience from the development of the green bonds market in China in recent years and the SDG Bonds Standard project at UNDP. This collaboration combines the strengths of the two UN agencies: UNDP’s expertise on developmental policy and its platform for the SDG Bond Standard; UNICEF’s framework for integrating children’s rights into impact assessments and its unique technical expertise in education, health, nutrition, water, sanitation and hygiene (WASH). On 28 April 2020, UNICEF and UNDP brought together 40 experts from international standard setting agencies, research and financial institutions, and young people for an online meeting to kick start the Child Bond Standard project. Developing this standard will require collaboration between international standard setters, research institutions, financial institutions and UN agencies. Financing is an important driver for achieving the SDGs. This challenge is not just about mobilizing funds and closing financial gaps. There is also a need to fundamentally realign financial markets and systems to prioritize the SDGs. The Child Bond Standard is an important step in this direction, offering an ambitious initiative for moving towards defining SDG-enabling finance for children’s well-being, and assessing the impacts of projects on children’s development. The first draft of the standard is expected by mid of 2021, with the final standard ready by the end of 2021 after a wide range of industry consultations. It is expected that the first pilot child bond will be issued by financial institutions in 2021 based on the Child Bond Standard. Mr. Shouqing Zhu, Senior Adviser of UNICEF China and Mr. Devanand Ramiah, Deputy Representative of UNDP China will lead the technical committee. UNICEF and UNDP are calling upon financial institutions and other interested stakeholders to join the technical committee to develop the Standard and prepare projects for bond issuance.

The bipartisan bill to which Warren refers sports the tendentious moniker, Digital Asset Anti-Money Laundering Act of 2022. Stripped of grandiose claims, it attempts to extend the financial surveillance state cooked up by drug warriors and anti-terrorism fearmongers to cryptocurrencies. Warren and company picked an opportune moment to do just that, while the public is occupied with a headline-grabbing financial scandal that taints crypto's already sketchy reputation. In fact, Sam Bankman-Fried's shenanigans at FTX, perhaps concealed by generous political donations, look old-school, including mingling personal and corporate funds in ways that would have raised red flags long before digital tokens. But they cast further shade over a crypto sector that had yet to gain acceptance by the American mainstream. After years of breathy warnings that cryptocurrency is shady, and speculative values detached from reality, many people are prepared to believe the worst. "Crypto is an interesting technology that had one terrible piece of bad luck: its standard-bearer, bitcoin, went up in value 10,000x over a few years," wide-ranging commentator Scott Alexander wrote earlier this month. "When something goes up in value 10,000x, it's hard to think of it in any other context. Whatever it was before, now it's 'that thing which went up in value 10,000x'." Alexander points out that, despite the shellacking the crypto sector is taking in the press and from politicians, it remains popular in countries where it's used for its intended purpose as a store of value and a means of exchange in defiance of authoritarian controls. "Vietnam uses crypto because it's terrible at banks," he notes. "There's a history of the government forcing banks to make terrible loans, and then those banks collapsing." In socialist Venezuela, "cryptocurrency provides a hard-to-ban alternative which has caught on among Venezuelan hustlers and small businessmen." This played out in Turkey when the government got serious about turning the lira into toilet paper and people bought gold, foreign currency, and bitcoin. Bitcoin also became a means for Canadian protesters to work around government attempts to financially isolate their protest movement. "Of course a technology centered around avoiding governance and banking failures will be centered in the countries with the most governance and banking failures!" Alexander adds. But any technology that can be used by good people can also be used by bad people. That's as true of window curtains as it is of crypto (or cash). The same privacy sought by a family going through evening routines might serve a terrorist building bombs, just as businesses and activists evading a hostile state might use the same currency that purchases bomb parts. Politicians love playing up potential abuses. "Following the September 11, 2001 terrorist attacks, our government enacted meaningful reforms that helped the banks cut off bad actors' from America's financial system. Applying these similar policies to cryptocurrency exchanges will prevent digital assets from being abused to finance illegal activities without limiting law-abiding American citizens' access," insists Sen. Roger Marshall (R–Kan.), co-sponsor of the Digital Asset Anti-Money Laundering Act of 2022. When politicians hold up the post-9/11 panic that supercharged the surveillance state as their model, take them seriously. The legacy of that time is widely recognized as an over-powerful government that intrudes into Americans' lives, subjecting our activities and communications to monitoring and diminishing our liberty. With their bill, Warren, Marshall, and company want to extend that surveillance to financial technology that was explicitly developed to empower individual liberty and privacy. "The bill first seeks to classify self‐<U+200B>hosted wallets as money service businesses," cautions the Cato Institute's Nicholas Anthony. "For those unfamiliar, self‐<U+200B>hosted wallets are merely the digital equivalent of a wallet in your pocket or purse. ... Where much of the financial surveillance in the United States depends on what's known as the third‐<U+200B>party doctrine, self‐<U+200B>hosted wallets offer individuals protection from government surveillance and censorship. Yet Senator Warren's bill would put an end to that protection." The bill, says Anthony, would "classify cryptocurrency miners, validators, and network participants as money service businesses." It "also sets its sights on cryptocurrency mixers" who "offer individuals the opportunity to enhance their privacy when using cryptocurrencies on public blockchains." In fact, the bill's language specifies that "the Secretary of the Treasury shall promulgate a rule that prohibits financial institutions from ... handling, using, or transacting business with digital asset mixers, privacy coins, and other anonymity-enhancing technologies." Senators Warren and Marshall talk about "terrorism" and "drug lords," but their clear goal (whether or not its within their reach, which is another matter) is to strip crypto of its ability to be used privately and without permission in the same way we use cash. Their objections to digital money also apply to banknotes and coins. Ultimately, it's not crypto they fear, but our liberty to earn, purchase, save, and donate without being impoverished, scrutinized, or stopped by government officials. Bitcoin and other digital tokens have their flaws, but they're an attempt to fulfill a widespread desire for reliable stores of value and means of exchange independent of control. And while all such forms of money are vulnerable to fraud and theft, that's already illegal. The Digital Asset Anti-Money Laundering Act of 2022 doesn't even attempt to address such crimes, instead, it's an attack on financial privacy and liberty. For all the reasons politicians are coming after crypto, you can bet that cash is next.

So inflation is used to lubricate the system, but it's a fools errand, because since inflation artificially spurs investment and spending, it increases the inefficiency in the economy, requiring even more lubrication in turn. A positive feedback loop. It's the way of fiat money, and there's no way around it. No one can stop it. The only way out is a decentralised and secure fixed supply money protocol, where inflation isn't a decision anyone can make. There is also the problematic way in which mainstream media ignored a potentially seismic third lawsuit filed against Jamie Dimon and certain members of the JPMorgan Chase Board of Directors last year. Judge Rakoff wasted no time in dismissing that case on technical grounds. The complaint credibly alleged that some JPMorgan Chase Board Members were in business with Epstein. Adding to the culpability of JPMorgan’s Board of Directors is the simple fact that they have not fired Dimon, as either Chairman or CEO, despite the unprecedented crime spree that has ensued as he sat at the helm of the bank. Under Dimon, the bank has been charged with an unprecedented five felony counts brought by the U.S. Department of Justice – admitting to all of them. Raising even more suspicions of the Board’s own culpability is that after the bank’s two most recent admissions to felony charges, Dimon was financially rewarded by the Board. The idea that politicians should know how citizens spend their money is a new and deeply flawed idea. An entire generation has been fooled into thinking this is a necessary part of finance and the world continues to double down on an unworkable system. Only 30 years ago when I started my career as a stockbroker/ financial advisor I could call you on the phone and sell you MSFT or IBM stock and I did not need your DOB or your social security number. You didn’t even need to have money in the account. The 1990s to the post 9-11 Patriot Act (which was a horrible law) saw a radical increase in AML /KYC requirements. These seem to get worse every year. In my office when we were first required to take a drivers license, the older brokers were incredulous: “What do you mean we need an ID for someone buying stocks?!? What’s next, you need an ID to buy gas or groceries?” Now, just 25 years later an entire generation thinks this is normal or how it should be. Worse yet, some think the system won’t work without it. The opposite is true — the compliance gums up the works and adds friction where it should not exist. While the regulator class arrogantly acts as if AML KYC is their birthright and ending it is some sort of untouchable rail, the justifications are weak. Why do we have these regimes? To stop “money laundering”? What is that? Who is the victim? Is it to stop “human trafficking” or “terrorism”? If so, how? Is it to “stop” the 12,000 entities on the OFAC list by messing with the 2,000,000,000 people not on the list? Are major criminals somehow stopped by this? Has it stopped crime? Even if it did, is it worth burdening millions of firms and billions of people with paperwork and procedures that slow down commerce? Shouldn’t efforts be made to go after the actual criminals rather than encumbering the entire world with an inefficient compliance regime? Money must be able to flow and move. People must be able to take risks and make investments as they choose. This is the lifeblood of a solid economy and the jobs, growth, prosperity and peace that comes with it. The US (and by extension much of the world due to our influence) is sacrificing jobs, innovation and opportunities by chasing an extremely ineffective and indirect compliance regime. The entire idea belongs back in the dumpster of history. Let the investigators chase terrorists & human traffickers for those actual crimes and let the other billions of us use and move our money as we wish.
