A Fed Whistleblower Reveals Efforts to Silence Him 30 Years Ago

Todd, Former New York Fed and Cleveland Fed Insider Walker F. Todd, Former New York Fed and Cleveland Fed Insider The U.S. Department of Justice needs to immediately appoint an independent Special Counsel to investigate how long and in how many ways the U.S. Central Bank (the Federal Reserve or simply “the Fed”) has been functioning as a protection racket for Wall Street mega banks. We’ll get to the latest revelation about the Fed bullying and intimidating a Fed official in a moment, but first some necessary background. In 2013 the American people learned that Carmen Segarra had been a bank examiner with a law degree at the Federal Reserve Bank of New York, one of Wall Street’s key regulators. Segarra charged in a Federal lawsuit that she was bullied by colleagues to change her negative examination of the powerful Wall Street mega bank, Goldman Sachs. Segarra detailed how her colleagues also obstructed and interfered with her investigation. When she refused to alter her findings, she was terminated in retaliation and escorted from the Fed premises, according to her lawsuit. Segarra’s lawsuit was dismissed by a federal judge, Ronnie Abrams, whose husband was engaged in legal matters for Goldman Sachs. Unfortunately for the New York Fed, however, the secret tape recordings that Segarra had made to document the matter, ended up going viral. Then there was the 2015 case of the Wall Street Journal reporter, Pedro da Costa, asking Fed Chair Janet Yellen an uncomfortable question about Fed leaks of confidential information and finding himself without a job. According to a deep dive by Max Moran, writing for The American Prospect, the individual who cracks the whip at the Fed to keep reporters in line is Michelle Smith, Fed Chair Jerome Powell’s Chief of Staff and the woman “who has served every Fed Chair of the last 30 years in some capacity—Powell, Janet Yellen, Ben Bernanke, and Alan Greenspan.” Intimidating the press to toe the line on asking acceptable questions and writing acceptable articles is not compatible with a free society. See our report: There’s a News Blackout on the Fed’s Naming of the Banks that Got Its Emergency Repo Loans; Some Journalists Appear to Be Under Gag Orders; and Mainstream Media Has Morphed from Battling the Fed in Court in 2008 to Groveling at its Feet Today. Then there was the stench around former Fed Chair Janet Yellen stepping down as Fed Chair and embarking on a multi-million dollar money grab dressed up as speaking fees at the banks regulated by the Fed. (See Janet Yellen’s Cash Haul of $7 Million Is Just the Tip of the Iceberg; She Failed to Report Her Wall Street Speaking Fees from JPMorgan and Others in 2018.) Yellen was then reconstituted as the U.S. Treasury Secretary, where her rubber stamp is required under Dodd-Frank financial “reform” legislation in order for the Fed to throw more trillions of dollars at Wall Street. And, finally, more than two years after the former President of the Dallas Fed, Robert Kaplan, was exposed as trading like a hedge fund kingpin while sitting on confidential Fed information, there has still been no investigative findings in this matter shared with the American people by the U.S. Department of Justice; the Securities and Exchange Commission; or the Fed’s Inspector General. Against that backdrop, consider the latest news about intimidation and efforts to silence a Fed official – going back 30 years. Last month, financial writer Lynn Parramore conducted an interview for the Institute for New Economic Thinking (INET) with two former Federal Reserve Bank employees: Walker Todd, a former attorney and legal officer at the New York Fed and a former legal and research officer at the Cleveland Fed; and Bill Bergman, a Clinical Instructor in Finance for Loyola University who worked previously at the Chicago Fed. During the interview, Todd stuns with this revelation: “I had the misfortune of drafting an article for publication by the Cleveland Fed, which came out in ’93, about the emergency lending provisions of FDICIA [Federal Deposit Insurance Corporation Improvement Act]. I explained how this came about. The sense of the provision was a section that said that the Fed was able to make emergency loans based on any collateral satisfactory to it – which could be just about anything. Changing that provision allowed securities firms to borrow directly from the Fed for the first time in history because the Fed discount window was originally set up to make loans only on types of collateral eligible for discount — and investment securities most definitely were not eligible for discount. “The Board staff turned out to be very unhappy with the submission of this article and kept intervening with my management to try to block publication. I was required to do 21 drafts over a year, which impeded my doing anything else. Eventually, it was published in mostly the same form in which I had originally submitted it, and at the last moment, a senior Board staffer called the research department at the Cleveland Fed to order them to stop the presses. But they couldn’t, because the president and research director were out of the office and couldn’t be reached. So it went out the door. That was it. A book he has spent the past decade researching and writing comes out today from the University of California Press: Busting the Bankers’ Club: Finance for the Rest of Us. Anticipation of this book’s release has caused some sweaty brows in the halls of Congress, on Wall Street, at Big Law, and in the economics community. That’s because Epstein is naming names – the names of the people who have sold out American democracy and the public interest by becoming sycophants for, or actual members of, the Bankers’ Club. The Chairman of the Bankers’ Club is the Federal Reserve, writes Epstein. That’s because the Fed has strongarmed its way to becoming both the supervisor of the Wall Street mega banks while also being able to create money at the flip of an electronic switch, which it uses to funnel trillions of dollars in cheap loans to bail out the mega banks behind a dark curtain. Alan Greenspan’s unprecedented 19-year reign as Fed Chair laid the foundation for this power grab while his successor, Ben Bernanke, enshrined the concept of regulator-turned-bailout-kingpin during the 2007 to 2009 financial crisis, (funneling $29 trillion in largesse to prop up a financial structure that had collapsed under the weight of its own corruption). Photo Credit, Stan Sherer The unprecedented power of the Bankers’ Club is underscored by the reality that after the worst financial collapse in 2008 among Wall Street firms since the Great Depression, the legislation passed to remedy the corruption, excesses, and abuses (the Dodd-Frank Act of 2010) was little more than a draft, left to compromised regulators to fashion into final rules. Epstein describes how Citigroup, with help from pals in the Bankers’ Club, gutted a key part of the legislation meant to rein in derivative abuses. (For more on this sleazy episode, read our report: Meet the Two Congressmen Who Facilitated Today’s Derivatives Nightmare at Wall Street’s Mega Banks.) Other key members of the Bankers’ Club according to Epstein are the politicians (particularly on key committees in Congress) who have sold out to the Bankers’ Club in exchange for funding of their political campaigns; bank regulators who have one foot on government soil and the other foot heading toward the revolving door and a much bigger paycheck; Wall Street’s outside lawyers from Big Law who sneak language favoring the Bankers’ Club into legislation; a swarm of dozens of lobbying groups working on behalf of Wall Street banks in the corridors and offices of Congress; and even members of his own profession – economists – who promote unsound ideas purporting to show that Wall Street mega banks serve the interests of the public and that more regulation is inefficient and negatively impacts economic growth. In each of the categories above, Epstein names names. A member of Big Law, the Senior Chair of Sullivan & Cromwell, H. Rodgin (Rodge) Cohen, makes the following appearance in Busting the Bankers’ Club: “…The dean of Wall Street lawyers, H. Rodgin Cohen, chair of the Wall Street firm Sullivan & Cromwell, had his hand in virtually all the key legal and enforcement actions promoting financial deregulation during this period. The work of these lawyers dovetailed with the lawyers and economists who developed the field of ‘law and economics,’ which, in a powerful alliance with the economists I mentioned earlier, provided a theoretical legal-economic basis for deregulation and a less interventionist state….” Opposing this conspiratorial Bankers’ Club is a talented, creative army of good guys, whom Epstein calls the “Club Busters.” High on Epstein’s list for accolades are the nonprofit watchdogs, Better Markets, Americans for Financial Reform, and the public banking advocacy groups across the country. While these groups deserve the accolades, along with the other groups and individuals mentioned by Epstein, there are two critical impediments preventing the Club Busters (including Wall Street On Parade) from achieving a serious victory in rolling back the power of the Bankers’ Club and genuinely reforming Wall Street. Those critical impediments are the repeal of the Glass-Steagall Act in 1999 and the Supreme Court’s Citizens United decision in 2010. The repeal of the Glass-Steagall Act (Banking Act of 1933) allowed Wall Street’s trading houses to control the trillions of dollars of life savings of mom and pop depositors. The repeal meant that global trading behemoths like JPMorgan were allowed to merge with federally-insured banks, back-stopped and thus subsidized by the U.S. taxpayer. Today, JPMorgan owns more than 5,000 Chase Bank branches spread from coast to coast across America, accepting federally-insured deposits from average Americans, who have no idea that their money is being used to corrupt foreign officials; rig markets; and prop up Ponzi schemes. To be more precise, the repeal of the Glass-Steagall Act is allowing Wall Street casinos to corrupt everything that Americans hold dear while using Americans’ own life savings to do it. The underfunded nonprofit watchdogs that make up the Club Busters’ simply can’t compete against this vast arsenal of weaponized deposits. Likewise, the Supreme Court’s Citizens’ United decision, and its progeny, opened the floodgates to corporate money’s ability to control U.S. elections. The U.S. is no longer a representative government of the people; it is, to an unprecedented degree, representative of corporate interests, the source of the money required to get into high public office. Until Americans understand clearly that Glass-Steagall must be restored and Citizens United must be overturned, we’re all just pesky little bull dogs nipping at the heels of the bankster class.

Over the past few weeks, it detected six missing transactions spending from OFAC-sanctioned addresses. This post examines whether these transactions were intentionally filtered because they spent from OFAC-sanctioned addresses or if there are other possible explanations for these transactions to be missing from blocks. I conclude that four out of six transactions were likely filtered. In September and October 2023, the RSS feed of my miningpool-observer instance reported six blocks missing an OFAC-sanctioned transaction. One block was mined by the ViaBTC mining pool, another by the Foundry USA pool, and four by F2Pool. An OFAC-sanctioned transaction is a transaction spending from or paying to an address sanctioned by the US Department of the Treasury’s Office of Foreign Assets Control. I maintain a tool to extract a list of OFAC-sanctioned addresses from the Specially Designated Nationals (SDN) list published by the OFAC. Concern of New York Prime Bank Instrument Fraud and Marketplace Manipulation The United States Department of the Treasury warns that Prime Bank Instrument Fraud schemes have attracted significant international attention, since individuals and organizations have lost billions of dollars worldwide. "Prime Bank Instrument Fraud" is the general term given to prime bank fraud schemes that go by many different names. During April 2021, Goldman Sachs could not in good faith (and, plausible deniability) make any reasonable claim of holding a pristine relationship with Turkey’s Central Bank or with Cyprus’ largest financial institutions, given the 1Malaysia Development Berhad scandal and then pending Deferred Prosecution Agreement with the United States of America. - Memo #4 suggests that Goldman Sachs developed a Prime Bank Instrument Fraud program to level out yo-yo market dynamics caused by failed marketplace manipulation exercises in Turkey and Cyprus. - Systematic bank fraud and/or marketplace manipulation of any kind between Turkey and Cyprus could constitute the war crime of aggression. - Furthermore, Memo #4 argues that Goldman Sachs may have tried to bambooze governments in New York, Cyprus and Turkey through regulatory arbitrage loopholes, while Goldman seemingly may have not considered the totality of such actions as war crimes. Turkey has the highest inflation in Europe. It has the second-highest rate of inflation among emerging markets, just behind Argentina. It has the 13th highest inflation rate in the world, ranking it between South Sudan and Nigeria. After Goldman Sachs was fined for illegal stock and bond market short selling by the Turkish government, logic would argue further malfeasance potentially could have been avoided by the DOJ’s 1Malaysia Development Berhad investigation. - On April 15, 2021 CNBC reported that Goldman Sachs (note, the previous section’s milestones of April 02, 2021 and April 20, 2021) crucially removed its bias toward Turkey tightening interest rates. Goldman issued guidance highlighting the fact that the bank thought that, “…the removal of the tightening bias against rising inflation expectations suggests that the TCMB (Turkish Central Bank) now has a more dovish reaction function.” - On August 14, 2021 the CyprusMail reported serious concern among economists about data reporting from the Turkish Statistical Institute. Ahmet Takan, a former official with the office of the Turkish prime minister, acted as a whistle blower, warning that Turkey potentially was manipulating inflation data. - On September 1, 2021 Reuters reported that Goldman Sachs hiked Turkish growth forecasts. Goldman economists issued guidance stating, "Overall, the Turkish economy has been able to grow faster than we thought without a deterioration in its external balances, as the pickup in foreign demand has been very supportive." - On November 30, 2021 Reuters reported that Goldman Sachs trimed Turkey’s 2022 growth forecast. Goldman Sachs' Murat Unur stated, "We think that the GDP figures released today tell us little about the pace of economic activity going forward as the recent sell-off in the Lira is likely to impact economic activity significantly" Mr. Marzulli, the DOJ’s Deferred Prosecution Agreement with Goldman Sachs was signed on October 21, 2021. The timeline of events above do not coincide with terms and conditions of the Deferred Agreement mandated by the United States of America. We are looking to learn more about the DOJ’s approach to assessing any potential breaches to the Deferred Agreement’s mandates as we determine New York State’s role in cross-border bank regulation and corresponding innovation beyond war crimes against humanity. 2. In order to establish whether a war crime or a crime against humanity has been committed, the case officer should consult the relevant international instruments and case law. 3. Crimes against humanity are fundamentally inhumane acts, committed as part of a systematic or widespread attack. Inhumane acts, which could reach this threshold when committed pursuant to or in furtherance of a State or organizational policy (potentially, New York State bank regulation). 4. Persecution against any identifiable group or collectivity on political, racial, national, ethnic, cultural, religious, gender, or other grounds that are universally recognised as impermissible under international law. 5. Furthermore, we have made 28 highlights to the Deferred Agreement providing supporting reference to Memo #4’s overarching premise. xNY.io - Bank.org submits Memo #4 for DOJ consideration of other inhumane acts of a similar character intentionally causing great suffering, or serious injury to body or to mental or physical health. It filed a federal lawsuit against the highest law enforcement agency and officer in the United States – the U.S. Department of Justice and the man who sat at its helm, Attorney General Eric Holder. The lawsuit challenged a $13 billion out-of-court settlement that had been agreed to by the Justice Department and the Wall Street mega bank, JPMorgan Chase, over its sale of toxic mortgages. Better Markets wrote on its website that this was at the time “The largest settlement in U.S. history from a single entity by more than 300%” and that it “granted JP Morgan blanket civil immunity for years of alleged, but undisclosed, pervasive, egregious and knowing fraudulent and illegal conduct that contributed to the 2008 financial crash and the worst economy since the Great Depression.” Among the many eyebrow-raising allegations in the Better Markets’ press release, these three stood out: “The Attorney General and other senior DOJ political appointees negotiated directly and entirely in secret with the CEO of JP Morgan Chase [Jamie Dimon], someone who was considered a possible Treasury Secretary just a few years ago. “The cellphone of DOJ’s third highest ranking official rang with the ‘familiar’ phone number of JP Morgan Chase’s CEO [Jamie Dimon], who called to offer billions of dollars to stop DOJ from holding a press conference and filing a lawsuit in just a few hours. The call worked, and the press conference and lawsuit were both called off. “DOJ gave complete civil immunity to JP Morgan Chase for defrauding thousands in exchange for $13 billion, via a contract that was negotiated and finalized in secret without any review or approval by a federal court.” Attorneys for the Justice Department asked the federal court to dismiss the Better Markets lawsuit on the basis that Better Markets lacked standing to file the lawsuit. The U.S. District Court for the District of Columbia did just that in a longwinded decision that effectively stripped Americans of their ability to fight back against the increasingly corrupt nexus between Washington and Wall Street. We reached out this week to Better Markets’ President and CEO, Dennis Kelleher, to explain how federal courts can get away with this type of cronyism. He responded as follows: “Unfortunately, the U.S. legal system is an unlevel playing field tilted in favor of Wall Street’s banks/Corporate America and against Main Street Americans/the public interest. That’s because judges require anyone bringing a lawsuit to show ‘standing’ to file a case, which almost always depends on a plaintiff showing quantifiable, concrete, and specific if not unique harm. Because banks/Corporate America can always show or make up some dollar amount of injury from a government action or rule, they virtually always have standing to sue. But Main Street Americans/the public interest almost always cannot because public harm usually is not quantifiable, concrete, specific or unique to a particular plaintiff. “For example, even if it was objectively true that the DOJ/Eric Holder sold out to JPMorganChase/Jamie Dimon, Better Markets’ case would have been thrown out because the harm from that sell out would be to everyone in the country and not a quantifiable, concrete, specific, or unique harm to Better Markets. The same is true if an agency like the CFTC or SEC knowingly enacted a rule that unlawfully favored the financial industry. Public interest groups or just ordinary citizens would likely get thrown out of court if they sued unless there was some unique harm inflicted. Put differently, while there are some exceptions, as long as the harm is to the broad public interest you basically cannot sue to protect the public interest.” If this sounds like the Kafkaesque court logic of a vast wealth transfer conspiracy, you’re thinking along the right lines. What it effectively shows is a money laundering operation where a recidivist bank pays $13 billion to a federal agency in the executive branch of government; bypasses the judicial branch of government; and walks away with immunity and no questions asked. If that feels more like a banana republic form of justice than that of a thriving democracy, welcome to the new world of kleptocracy in America. Nine months after Better Markets had filed its lawsuit, its worst suspicions about the secret backroom deal materialized in the pages of Rolling Stone under the byline of Matt Taibbi. The Justice Department had silenced the perfect eyewitness, Alayne Fleischmann, a former attorney at JPMorgan Chase who had reported the wrongdoing to her superiors. What Fleischmann described to Taibbi was “massive criminal securities fraud” within the bank. Taibbi describes what happened to Fleishmann as follows: “Six years after the crisis that cratered the global economy, it’s not exactly news that the country’s biggest banks stole on a grand scale. That’s why the more important part of Fleischmann’s story is in the pains Chase and the Justice Department took to silence her.” The Justice Department announced its $13 billion civil settlement with JPMorgan Chase on November 19, 2013. At the time, it clearly knew that it would be bringing stunning criminal charges against the same bank just 49 days later. On January 7, 2014, the Justice Department shocked the country with the announcement that the largest federally-insured bank in the U.S., JPMorgan Chase, had played a key role in the largest Ponzi scheme in history – that of Bernie Madoff. And because the bank hid its suspicions from U.S. law enforcement that a Ponzi scheme was occurring and failed to file the legally-mandated Suspicious Activity Reports, the Justice Department charged the bank with two criminal felony counts. But instead of prosecuting the case in a federal court, where the disgusting details would play out in newspaper headlines for months, the Justice Department allowed the bank to admit to the charges and walk away with a hefty fine and a two-year deferred prosecution agreement; meaning that if the bank did not violate its two-year probation, it would never be prosecuted for these crimes. Since 2014, this kind of backroom deal between JPMorgan Chase and the Justice Department has become enshrined as the new standard for crony justice between Wall Street and Washington. JPMorgan Chase has racked up five felony counts, received three deferred prosecution agreements and two non-prosecution agreements. (See the highlights of its breathtaking rap sheet here.) And yet, there is zero indication that JPMorgan Chase’s appetite for crime as a business model has been satisfied. The Attorney General of the U.S. Virgin Islands last year brought credible evidence into federal court in Manhattan that JPMorgan Chase “actively participated” in Jeffrey Epstein’s sex trafficking of minors by ignoring a decade of his money laundering inside the bank – the very money laundering conduct that resulted in the bank admitting to two felony counts in 2014 in the Madoff case. In both matters, the bank failed to file the legally mandated Suspicious Activity Reports with the Financial Crimes Enforcement Network (FinCEN) despite internal communications showing it was well aware that the financial transactions were highly suspicious. Despite the Justice Department and FBI sitting on reams of evidence in the Jeffrey Epstein/JPMorgan case since 2008, the DOJ has brought no criminal charges against the bank related to Epstein. Notwithstanding this unprecedented crime wave at JPMorgan Chase, and the ability of Jamie Dimon to not only remain at the helm of the biggest bank in the U.S. but to become a billionaire from the stock options lavished on him by his Board, federal regulators again proved themselves to be the lapdogs that millions of Americans suspect them to be when they allowed JPMorgan Chase to get $200 billion bigger last year. George Washington University Law Professor, Art Wilmarth, author of Taming the Megabanks: Why We Need a New Glass-Steagall Act, explained during the Better Markets conference in September of last year exactly what transpired in the spring of 2023 when regulators handed JPMorgan Chase the collapsed bank, First Republic: “…When First Republic failed, regulators did not invoke the systemic risk exception. That was a clear and rather shocking error in my opinion. They accepted JPMorgan’s bid to buy most of the assets and assume all of the deposits of First Republic. “By the way, JPMorgan recorded a profit of almost $3 billion on that transaction. The Deposit Insurance Fund has recognized a loss of at least $13 billion and it may be larger on that transaction. That’s a hard result to justify and I don’t think the FDIC has attempted to justify it and I don’t think they can… “So what they did was to impose a loss of $13 billion on the Deposit Insurance Fund, which must be reimbursed by all the banks, not just the big ones, not even the banks larger than $5 billion – all the banks – meanwhile handing JPMorgan a $3 billion profit; increasing JPMorgan’s size by more than $200 billion and allowing JPMorgan to grow to a size of more than $4 trillion. By the way, also waiving any anti-trust review because First Republic Bank was a failed bank, so there was no anti-trust review.” If this is not the kind of “democracy” that you want to leave to your children and grandchildren, pick up the phone today and call your U.S. Senators’ office and demand the appointment of a Special Counsel to investigate these backroom deals between the Justice Department and JPMorgan Chase.

https://wallstreetonparade.com/2024/01/everything-thats-dangerous-about-u-s… By Pam Martens: January 17, 2024 ~ The Bankers' New ClothesAnat Admati, Professor of Finance and Economics at Stanford Graduate School of Business, and German economist Martin Hellwig, have performed a public service to all Americans with their newly released, updated and expanded book The Bankers’ New Clothes: What’s Wrong with Banking and What to Do about It. It puts the interlocking web of corruption that is mistakenly referred to as the U.S. banking system into a pristinely documented and highly readable book. Let us first explain those men without pants on the book jacket. That provocative graphic comes from the storyline in the Hans Christian Andersen tale “The Emperor’s New Clothes.” Tailors offer to make the emperor magical clothes that will be visible only to smart people and invisible to the stupid and unfit. When the emperor’s ministers go to inspect the clothes, they see nothing, but they are fearful of being called stupid if they admit this. The emperor, also fearful of being regarded as intellectually lacking, says nothing and tours the capitol in his nonexistent garments. Only a child is brave enough to shout out in the capitol “The emperor has no clothes,” thus breaking the conspiracy of silence. The authors explain in example after example how corruption has taken over the banking system today but the guardians of our democracy have bought into the “pervasive myth that banks and banking are special and different,” so they have allowed themselves to be socialized to silence out of fear of being “declared incompetent to participate in the discussion.” As I read that insightful analogy, the image of 60 Minutes’ Lesley Stahl treating JPMorgan Chase’s crime boss, Jamie Dimon, like a revered financial wizard in a televised interview in 2019 flashed through my mind. (Less than a year after that program aired, JPMorgan Chase admitted to another two felony counts brought by the U.S. Department of Justice, bringing its total to an unprecedented five felony counts in the span of six years.) A key area on which Admati and Hellwig shine much needed sunshine is the accounting gimmickry that allows U.S. banks to hide billions of dollars in losses on bonds by simply labeling them “held to maturity” securities. (For background, see here and here.) The authors write that “Accounting rules should be changed so that banks must apply fair-value accounting to all assets regardless of how long they intend to hold them.” Admati and Hellwig also provide brilliant new insights into the second, third and fourth largest bank failures in U.S. history that occurred in the spring of last year. Those bank failures resulted in the Federal Reserve creating yet another new bailout program, the Bank Term Funding Program, despite the American people being reassured since 2010 that the Dodd-Frank financial reform legislation ended “too big to fail.” The authors compare the persistent attack by banks, their lobbyists, and their toadies in Congress that bank regulations impose a “cost” on society to “chemical companies complaining about increased costs when they are prohibited from dumping toxic chemicals into rivers next to their plants.” This is a spot-on comparison considering that the worst financial crisis in the U.S. since the Great Depression occurred from 2007 to 2010 as a result of the Wall Street mega banks dumping their toxic mortgage securities across the financial landscape of America and imploding a vast stretch of it. The final chapter of the book, “Above the Law?” is a testament to the encyclopedic banking knowledge of the authors. They have selected some of the most revealing episodes of banking crimes to illustrate how Americans now live under the jackboot of Wall Street banking titans with all avenues of redress locked up tight. One example cited in the chapter is vital to understanding the perilous nature of how Americans have been stripped of their ability to fight back against the banking cartel – whose tentacles now extend into the courts, the Congress, the Justice Department and federal prosecutors’ offices across the land. On November 19, 2013 the Justice Department, together with a number of state attorneys general, announced a stunning $13 billion settlement with JPMorgan Chase for “misleading investors about securities containing toxic mortgages.” The Justice Department’s Statement of Facts was so devoid of critical details that it was impossible to unravel the scope of what had gone down. The nonprofit watchdog, Better Markets, was so incensed by the subterfuge that it filed a lawsuit against the U.S. Department of Justice in February 2014, writing as follows: “…the Executive Branch, through DOJ, acted as investigator, prosecutor, judge, jury, sentencer, and collector, without any review or approval of its unilateral and largely secret actions. The DOJ assumed this all-encompassing role even though the settlement amount is the largest with a single entity in the 237 year history of the United States and even though it provides civil immunity for years of illegal conduct by a private entity related to an historic financial crash that has caused economic wreckage affecting virtually every single American. The Executive Branch simply does not have the unilateral power or authority to do so by entering a mere contract with the private entity without any constitutional checks and balances. “Notwithstanding such extensive and historic illegal conduct that resulted in a $13 billion payment, the DOJ did not disclose the identity of a single JP Morgan Chase executive, officer, or employee, no matter how involved in or responsible for the illegal conduct. In fact, the DOJ did not even disclose the number of executives, officers, or employees involved in the illegal conduct or if any of them are still executives, officers, or employees of JP Morgan Chase today. Moreover, the DOJ did not disclose the material details of what these individuals did, when or how they did it, or to whom and with what consequences. The DOJ was even silent as to which specific laws were violated, to what degree, and by what conduct. The DOJ also did not disclose even an estimate of the amount of damage JP Morgan Chase’s years of illegal conduct caused or how much money it made or how much money its clients, customers, counterparties, and investors lost. Remarkably, the DOJ does not even clearly state the period for which it is granting JP Morgan Chase immunity….” So what happens when a genuinely non-partisan watchdog attempts to stand up for the rights of everyday Americans against the largest and most serially-charged bank in America? The federal court dismissed Better Markets case on the basis that it lacked standing. The Attorney General at the Justice Department at the time of Better Markets’ lawsuit was Eric Holder, who did not bring one criminal charge against any top Wall Street executive despite the worst financial collapse since the Great Depression and despite the Financial Crisis Inquiry Commission referring nine individuals to the Justice Department for potential criminal prosecutions. Eric Holder and his head of the criminal division at the Justice Department, Lanny Breuer, both hailed from Covington & Burling, the corporate law firm that a federal judge called out for fronting for Big Tobacco for decades. Summing up where we find ourselves today, the authors write: “In an earlier era, conflicts between aristocrats and ordinary people would be decided in favor of the aristocrats no matter what; judges who were themselves aristocrats took it for granted that people of their own class must prevail. Some of the developments that we have sketched suggest that we may be returning to such a system. Harris added that the department’s updated check cashing regulation replaced an “outdated methodology” that granted annual, automatic, Consumer Price Index (CPI)-based fee increases to check cashers. “The new methodology which has been upheld in court today takes into account the needs of consumers who use check cashing services, creating a fairer fee setting process,” Harris said. The check cashing regulation updates methods that had been in place since 2005, PYMNTS reported when the new rules were announced in January. When outlining the new rules, the NYDFS maintained that the previous approach did not take into account the “disproportionate impact inflation has” on state residents using check cashing services. If wages were stagnant but the CPI rose, customers would be hit by the higher fees and higher cost of living. Now, a two-tiered system will be set up: 1.5% fees will be assessed on public assistance checks issued by government agencies. Other checks will be subject to a fee of $1 or a 2.2% fee, whichever is greater. The agency disclosed that the regulation does not apply to commercial checks, “which are not subject to statutory fee limits, or fees generated from other services that check cashers often provide” including wire transfers and bill payments. The fees will be the same for both in-person and mobile check cashing. The New York Post reported in March that the check-cashing rate had been 2.27% and that the check-cashing centers that were the plaintiffs in a suit filed against the new rules said the changes were “arbitrary and capricious.” A 2022 assessment conducted for the industry said that the lower fees would make check-cashing companies “unprofitable” and force their closures, according to the report. In Thursday’s press release lauding the court decision, Harris said: “I will continue to advance policies that support opportunity and access to quality financial services for all New Yorkers.”
