Dear Cyberspace Administration of China: It has been over one month since our inquiry, and I am kindly following up on the message below. Please note, the question concerning Proof of Transfer is critical to determining any degradation to the Bitcoin blockchain's software purity. As such, it would be ideal to determine Hong Kong's approach to Network Data Security <http://www.cac.gov.cn/2021-11/14/c_1638501991577898.htm> (Draft for Comment) issued by your office. Re: FOIL Request No. 2022-090560 - Larson
by Gunnar Larson 08 Sep '24

08 Sep '24

Good morning: We would like to appeal this decision. “We would like to receive any and all records, relating to NY-DFS' 2021 Apple Card Investigation. This is one part of a broader discussion we must have about equal credit access. On March 23, 2021, Ms. Linda Lacewell published NY-DFS' Findings on Apple Card and its Underwriter Goldman Sachs Bank. As the former Superintendent of NY-DFS, Ms. Lacewell's stone faced propaganda assured that Apple Card did not discriminate against women, while under Goldman Sachs management. The red flags started to appear when an authorized user drew attention to the following: A person who relies on a spouse's access to credit, and only accesses those accounts as an authorized user, may incorrectly believe they have the same credit profile as the spouse. We recently collated 61 highlights to the Report on Apple Card Investigation from March 2021: https://drive.google.com/file/d/1xH16OKyuXzB-MVqIznMWDE9w8RRdmZCw/view The Apple Card investigation was to assess women's access to equitable finance. The integrity of the Apple Card investigation must be rationally considered as flawed. We would like to receive any and all records of Ms. Linda Lacewell's (emails, texts, and similar) involvement with the 2021 Apple Card report. We would like to receive any and all records to NY-DFS association to evaluating Ms. Linda Lacewell's ability to score a report specific to the Apple Card's core subject of credit access for women. Finally, we would like to receive any and all records related to NY-DFS guidance on Interlocking Directorates ( https://www.dfs.ny.gov/apps_and_licensing/banks_and_trusts/other/Permission… rlocking_Directors_and_Officers), specific to Apple's Board of Directors and Goldman Sachs' Board of Directors.” Please forgive my candor, but if DFS actually conducted an 'Apple Card Investigation' ... There would be some records relating to the investigation. UK: The Scrutiny Of Celebrity Influencers' Social Media Endorsements May Help To Reduce Financial Fraud Scams
by Gunnar Larson 08 Sep '24

08 Sep '24

https://www.mondaq.com/uk/white-collar-crime-anti-corruption-fraud/1238238/… Financial fraud continues to rise year on year, the cost of living crisis will drive even more people to look for ways of enlarging their income and inevitably fall for fake investment opportunities presented to them. As the regulating authorities and law enforcement introduce measures to obstruct the methods fraudsters use to target victims, the fraudsters adapt their scams accordingly. The vehicle of social media has given the fraudulent brokers a platform where they can present their scams to thousands of people via Instagram through the practice celebrity endorsement where well-known celebrities or influencers promote a particular product or investment opportunity, often leading their followers to believe that the celebrity has a full understanding of the product or investment they are endorsing. Such endorsement may become less appealing following the fine of $1,26 million delivered to Kim Kardashian by the US Securities and Exchange Commission <https://www.sec.gov/> (SEC) for failing to divulge to her 225 million Instagram followers that she was paid $250,000 for promoting the crypto asset Ethereum Max. Ms. Kardashian made it clear that she was not providing financial advice but went on to say that her friends were telling her about Ethereum Max tokens. The SEC Chair Gary Gensler pointed out that "...investing public shouldn't confuse the skills of celebrities <https://www.cnn.com/2022/09/15/business/kanye-west-gap-termination> with the very different skills needed to offer appropriate investment advice..." *Joanna Bailey, <https://www.mondaq.com/redirection.asp?article_id=1238238&company_id=24606&…> head of the banking and financial fraud litigation department, commented "the public recognise and trust the celebrities that endorse investment schemes and think that they have real involvement and understanding of the investment they are promoting." Joanna further pointed out "Kim Kardashian is not the only celebrity to have promoted investments, Katie Price unwittingly endorsed a Forex scam. Urging members of the public who have no understanding of Forex or crypto markets to consider such investments is inappropriate and often leads them into financial scams resulting in losses"* Our lawyers in the banking and financial fraud litigation department <https://www.mondaq.com/redirection.asp?article_id=1238238&company_id=24606&…> keep ahead of the scams and the methods used to defraud unwitting investors. Giambrone & Partners now leads the field following our recent groundbreaking case where the High Court of England and Wales granted permission to serve notice of proceedings on persons or persons unknown in connection with two digital wallets over blockchain by a non-fungible token (NFT). The case was the second case in the world and the first case in Europe to serve Court papers as an NFT through blockchain and is particularly significant with regard to crypto scams due to the fact that the perpetrators are often anonymous. This method of service avoids the need for identity. The challenging economic climate currently being experienced will almost certainly lead to more people seeking out "get rich quick" investment schemes. Our lawyers in the banking and financial fraud litigation department strongly recommend resisting the temptation and point out that if you are told that you must take action immediately or the opportunity will go, it is almost certainly a scam. Joanna Bailey frequently leads the litigation against financial institutions involved in Forex/binary trading disputes, as well as cryptocurrency issues and regulatory investigations and has some considerable success in retrieving the funds lost in fraudulent investment schemes. Joanna has developed a range of strategies both to find the assets of the individuals perpetrating the fraudulent schemes and restore the funds to our clients. As well as recognising culpability in the organisations facilitating (but not associated with the fraud), by failing to undertake adequate due diligence. She is highly experienced in high-value out-of-court settlement negotiations and has in-depth knowledge of the Civil Procedure Rules as well as English common law. *The content of this article is intended to provide a general guide to the subject matter. Ms. Chollett: Thank you, kindly, for continued correspondence related to Meta Board questions specific to xNY.io - Bank.org, PBC's concern to protecting cross-border digital asset innovation. xNY.io - Bank.org, PBC first became alarmed through Meta's obvious digital asset market problems related to Libra, Diem, Novi and USDP. Through Meta's continued digital identity transitions, xNY.io - Bank.org, PBC has pioneered cross-border digital asset logic(s). Moreover, the Moscow Exchange and Meta introduced market events over March that jeopardize digital asset market purty. Ms, Chollett, xNY.io - Bank.org, PBC will not pay for market effects related to Meta's cross-border disruption of digital asset innovation, related to Meta's obvious mark exactness (by definition) to the Moscow Exchange. *Ms. Chollett, we cannot concern ourselves with Meta's intentions, good or otherwise, given clear problems that exacerbate market risk: * - March 11, 2022 <https://www.businessinsider.in/tech/news/russia-moves-to-declare-meta-an-ex…>: Russia's leader, who is in charge of the Moscow Exchange cites Meta as an 'extremist organization' ... - March 14, 2022 <https://www.lexology.com/library/detail.aspx?g=ff9f1af5-cc8a-473a-822b-8890…>: Frankfurt Kurnit Klein & Selz PC Benjamin G. Directorates Who Discredit Truthful Witnesses (W/80 Highlights)
by Gunnar Larson 19 May '24

19 May '24

“And the persons who ultimately are harmed by all of this, of course, is the average consumer, the average citizen, who has no knowledge, unless it paid attention to this hearing, of the extent of the manipulations that have been carried out by the largest financial institutions in America and, indeed, probably the world.” - Senator John McCain *Highlights and working notes on the ethical limits of discrediting the truthful witness, observing modern directorates and ethics rules that fail to prevent truth distortion by unethical means (Source research by Marquette Law Review).* History provides the epic example of Enron and a cunning Board of Directors of misleaders, a team of flimflam artists who used sly rhetorical skills to bamboozle the public, turning night into day. In this conception, directorates tell stories only in order to seduce and beguile regulators who fall prey to the advocate’s star-crossed tricks. Why do company Directors employ unethical, false story techniques to advance a false defense when ethical means are available? The exponential effects of this troublesome behavior requires that the firm’s every word, action and attitude be consistent with the conclusion that is dishonest. Board directors are the ultimate self policing body of an organization, responsible for setting the tone for ethical rules and standards. Not only are modern ethical rules unable to prevent directorates who use of false-story techniques, but little can be done in the way of reforming the rules themselves so that they can more effectively regulate the unethical means by which honesty is systematically discredited and made to look untruthful. - As witnessed in New York State recently, top leaders sometimes ignore ethical rules by rationalizing away conduct known to be unethical standards of professional behavior. - More abstract-oriented discussions concerning whether society’s best interests are advanced with attempts to distort outcomes by discrediting the truth has even impacted virtual currency innovation out of New York. These points simply seem invented as an outrageous scenario presented to the public by way of question, yet they are indeed true. - There is a pattern of routinely using an arsenal of tricks to subvert the truth. The culprit may argue that the version of events is untruthful, because of a motive to fabricate the truth. In actuality, incompetence is the only true motive to fabricate directorate supported dishonesty. Now more than ever, honest and ethical leaders know that each time a directorate uses talents and skills to pollute the marketplace with lies (either explicit or implicit) to manipulate profits is an act that initially diminishes the chances of a prosperous society. Such practice of engaging in conduct that involves dishonesty, fraud, deceit or misrepresentation is impermissible and should not be tolerated. Without swift action, the public may lose confidence in both system wide innovation and maximizing the whole human potential of our species. - Alternatively, employing truthful answers to string together a series of inferences that collectively weaken the case of interlocking directorates. - Vigorously defending potentially problematic interlocking directorates can be systematically re-purposed with the goal of protecting the innocent. We share 80 highlights to Todd A. Berger’s (published by Marquette Law Review) “The Ethical Limits of Discrediting the Truthful Witness: How Modern Ethics Rules Fail to Prevent Truthful Witnesses from Being Discredited Through Unethical Means.” https://thecapital.io/article/directorates-who-discredit-truthful-witnesses… -- *Gunnar Larson - xNY.io <http://www.xNY.io> | Bank.org <http://Bank.org>* MSc <https://www.unic.ac.cy/blockchain/msc-digital-currency/?utm_source=Google&u…> - Digital Currency MBA <https://www.unic.ac.cy/business-administration-entrepreneurship-and-innovat…> - Entrepreneurship and Innovation (ip) G(a)xNY.io +1-646-454-9107 New York, New York 10001

Breaking News: Robinhood Rebrands as 'Libra'
by Gunnar Larson 12 May '24

*SILICON VALLEY - Embroiled in the naturally malevolent evolutionary controversy of brand fakery <https://thecapital.io/article/robinhoods-brand-fake-vs-paypals-crypto-corru…> in the name of manipulating humanity, Robinhood Markets (a financial services company) rocked the brand marketing world by finally coming to its senses while vindicating Mr. Hood’s legacy. The company has distanced itself from the old Robinhood firm image of “we take advantage of our customers” with a fresh rebrand as ‘Libra.’* *Celebrated humanitarian Richard Simmons applauded the name change. “Mr. Hood’s story of altruism is loved by young and old alike world-wide. Today Mr. Hood is vindicated from association to the former Robinhood’s tricky company shenanigans. The new ‘Libra’ image is a super smart act of serving our country well... I hope the all-stars at Bear Stearns will join me in congratulating the new ‘Libra’ brand,” Simmons said.* *The nature and timing of the brand change raised eyebrows in New York, a recent familiar reaction to news from our pal <https://thecapital.io/article/robinhoods-brand-fake-vs-paypals-crypto-corru…>s from the Valley.Gleefully contemplating the long term impact on society, this reporter touts the courage of the real Mr. Hood for opposing forces similar to that of the former Robinhood.History will celebrate the newly minted Libra, which will be hailed for its valor in rebranding, even though it did so to escape the regulatory cloud that has hung over the Robinhood project since it first came into the public domain.(A Satirical Monograph on the News) *

Hong Kong and Singapore Litigation Investment Forecast
by Gunnar Larson 12 May '24

Hong Kong and Singapore Litigation Investment Forecast <https://litigationfinancejournal.com/hong-kong-and-singapore-litigation-inv…> International arbitration has experienced an uptick in activity over the past decade, with litigation finance driving increased accessibility to quality arbitration outcomes. Hong Kong and Singapore have both passed regulations to authorize third party funding in each jurisdiction. New research sponsored <https://drive.google.com/file/d/1eqM4r9MPm7JDSBEo8QlHcG8uKDTrW13t/view?usp=…> by the Chinese University of Hong Kong, led by faculty of law professor Can Eken profiles Hong Kong and Singapore’s regulatory environment in granular detail. Eken compares and contrasts nuances between both markets, while asking what innovations Hong Kong and Singapore may embrace to further expand third party funding engagement across the international arbitration spectrum. Governments in Hong Kong and Singapore overwhelmingly embrace a ‘soft touch’ approach to litigation finance regulation. Forecasting the region’s growth prospects signal both Hong Kong and Singapore are in competition to be Asia’s arbitration capital, supported by friendly third party funding regulation. Eken suggests that with the high cost associated with international arbitration, viability is often framed by financial capacity. With such need, Hong Kong and Singapore are recognized as having pioneered international arbitration regulation, legalizing the use of third party funding agreements. As an added bonus, we have included 36 highlights <https://drive.google.com/file/d/1eqM4r9MPm7JDSBEo8QlHcG8uKDTrW13t/view?usp=…> to Eken’s 23 page essay for your general reference. -- *Gunnar Larson - xNY.io <http://www.xNY.io> | Bank.org <http://Bank.org>* MSc <https://www.unic.ac.cy/blockchain/msc-digital-currency/?utm_source=Google&u…> - Digital Currency MBA <https://www.unic.ac.cy/business-administration-entrepreneurship-and-innovat…> - Entrepreneurship and Innovation (ip) G(a)xNY.io +1-646-454-9107 New York, New York 10001
