Serena Longley, deputy counsel for the attorney general's office, said that policies are in place to protect the confidentiality of the witnesses and their allegations. The office, Longley said, "has policies in place to protect the privacy and confidentiality of cooperating witnesses, including policies against releasing names of witnesses or information about their allegations." Timeline of events James' office first became aware of the allegations on October 2, according to a timeline provided by Longley. The next day, Khan was told to work remotely and not to socialize with staff or anyone affiliated with the attorney general's office until an internal investigation had been completed, according to an internal email provided by the attorney general's office. A day later, the law firm of Littler Mendelson agreed to investigate the allegations, according to documents released from the AG's office. "That was done because of the specific circumstances and position of the employee," Longley stated in the timeline shared with CNN. "The OAG took extra precautions to ensure a fair, impartial, and thorough review by hiring an outside firm." The AG's Sexual Harassment Prevention policy provided by the office states that when warranted "the (Equal Employment Opportunity) Officer will promptly and thoroughly investigate reports of sexual harassment, whether received in writing or orally. The confidentiality and privacy of those involved will be preserved to the extent possible, consistent with a full and fair investigation and appropriate remedial or disciplinary action." Khan issued a statement after news of the allegations and his resignation on Friday. "After a successful four-year term, I've been slated to leave the office for the private sector at the end of this year," Khan said in the statement. "This is unrelated to an investigation which, nevertheless, found no official workplace misconduct. I'm proud of all we have achieved over these past four years in serving New Yorkers." Khan declined to comment to CNN when reached Tuesday morning. NY AG's office says Cuomo probe was different James led the investigation into former Democratic Gov. Andrew Cuomo, which concluded he had "sexually harassed multiple women and violated state law," in August 2021. Cuomo announced he'd resign in August 2021, but has continued to deny any wrongdoing. According to the office, an internal investigation conducted by an employer is different than any statutory investigation into an allegation of misconduct by an elected official, and there are legal obligations as an employer to conduct "a prompt, fair, and impartial review that protects the privacy of those making allegations and any other witnesses." "This is more proof that Tish James has corrupted the AG's office, abusing power to further her own political ambitions through a sham report, while actively lying to the public to cover up what, by her own definition, are serious allegations of serial sexual misconduct by her closest aide," said Rich Azzopardi, a spokesman for Cuomo. "She 'believes all women' when it's in her political interest — otherwise, she attacks the accuser or covers up the complaint," Azzopardi said. If you’re Jamie Dimon, Chairman and CEO of the largest bank in the U.S. with 5,023 bank branches across the country taking in cash each day that represents the life savings of moms and pops and pension funds, announcing that 10 percent of last year’s new hires had criminal backgrounds is not exactly a confidence builder – especially since Dimon’s bank has been charged by the U.S. Department of Justice with an unprecedented five criminal felony counts since 2014. All of the felony counts occurred during Dimon’s tenure as Chairman and CEO, and while his Board of Directors made him a billionaire with stock grants and bonuses. In addition, the bank has a broader rap sheet that likely draws the envy of the Gambino crime family. On May 4, Dimon penned a guest opinion piece for The Columbus Dispatch. (The bank has a large operating center in Columbus.) The article includes this: “JPMorgan Chase has a meaningful portion of colleagues who have a criminal background — in 2021, 10% of our new hires in our company had a criminal record — and retention rates for this population are very high.” JPMorgan Chase was so proud of that article that it placed it on its corporate website. Our skepticism about Dimon’s real agenda is fueled not just by those five felony counts and former lawyers at the bank telling regulators that fraud is condoned at the bank, but also by revelations that came out of a hearing of the U.S. Senate’s Permanent Subcommittee on Investigations on November 21, 2014. Those revelations were as follows: On April 29, 2010 at 7:47 in the evening, Francis Dunleavy, the head of Principal Investing within the JPMorgan Commodities Group sent an email to a colleague, Rob Cauthen. The email read: “Please get him in ASAP.” The man that Dunleavy wanted to be interviewed “ASAP” was John Howard Bartholomew, a graduate of George Washington University Law School two years earlier. But it wasn’t his law degree that Bartholomew featured at the very top of the resume he sent to JPMorgan; it was the fact that while working at Southern California Edison in Power Procurement, he had “identified a flaw in the market mechanism Bid Cost Recovery that is causing the CAISO [the California grid operator] to misallocate millions of dollars.” Bartholomew bragged in his resume that he had “showed how units in reliability areas can increase profits by 400%.” These internal emails from JPMorgan and Bartholomew’s resume became Exhibit 76 in a two-year investigation conducted by the U.S. Senate’s Permanent Subcommittee on Investigations into Wall Street’s vast ownership of physical commodities and rigging of commodity markets. The late Senator Carl Levin, the Chair of the Subcommittee at the time, had this to say about the resume at the hearing: “There’s two things that I find incredible about this. First, that anyone would advertise in a resume that they know about a flaw in the system — signaling that they’re ready and willing to exploit that flaw. And, second, that somebody would hire the person sending that signal.” JPMorgan not only hired Bartholomew, according to the Senate’s findings, but within three months from the date of the email to Dunleavy, “Bartholomew began to develop manipulative bidding strategies focused on CAISO’s make-whole mechanism, called Bid Cost Recovery or BCR payments.” By early September, the strategy to game the system was put into play. By October, the JPMorgan unit was estimating that the strategy “could produce profits of between $1.5 and $2 billion through 2018.” The strategy of gaming the Bid Cost Recovery payments, or BCR, was producing such windfall profits that another JPMorgan employee sent an email on October 22, 2010 to his colleagues, joking about the success by featuring a photograph of Oliver Twist holding out an empty bowl with the subject line: “Please sir! mor BCR!!!!” During the Senate hearing, Senator Levin commented on the email and the reference to Oliver Twist, stating: “Now the BCR refers to the make-whole payments that JPMorgan was using to unfairly profit from the system. And I gotta tell you it’s mighty offensive to me that JPMorgan portrays its actions as a joke, comparing itself to a poor orphan needing charity when it was ripping off consumers.” We’re also skeptical of Dimon’s genuine commitment to workers’ welfare because of exchanges that occurred between Dimon and members of the House Financial Services Committee at a hearing on April 10, 2019. Dimon was questioned by Congressman Al Green of Texas on whether it was true that JPMorgan Chase had released information in 2005 “indicating that it directly benefited from slavery” and had made loans using slaves as collateral. Dimon said he believed this was true. In fact, according to a 2005 report in The Guardian, it was actually worse than that – the bank’s predecessor institutions had actually owned slaves. Two banks that are now part of JPMorgan Chase made loans to plantation owners of slaves in the 1800s, accepted 13,000 slaves as collateral, and “ended up owning about 1250 slaves” when the plantation owners defaulted on the loans, according to The Guardian report. As if that disclosure wasn’t bad enough in one hearing, Congresswoman Katie Porter also revealed the paucity of wages Dimon was paying his bank tellers. Porter asked Dimon for help with a math problem. Porter explained how Jamie Dimon’s $31 million in compensation in 2018 compared to what the bank is paying one of its bank tellers who is a single mother with a 6-year old daughter. Porter explained that she went to Monster.com and found a job in her hometown of Irvine, California for a bank teller at JPMorgan Chase. She said the job pays $16.50 per hour or $35,070 per year or an after-tax amount of $29,100 for a single mother with a six-year old child. After deducting for rent on a 1-bedroom apartment, utilities, car payment on a 2008 car, gas, food, the cheapest cell phone, and after-school child care, the woman would be $567 in the hole each month. Porter asked Dimon how this woman should manage her budget short-fall while she’s working full time at his bank. Dimon said: “I don’t know that all of your numbers are accurate” (which prompted Porter to post the photo below on her Twitter page after the hearing). One of the huge changes I've experienced was strong inhibition around thoroughly reviewing things. Before all this, I would read an entire chip spec from from to end, every word on every page, before coding for that chip, and I wouldn't have to read it again: not because I had any kind of eidetic memory, but because I noted each thing that seemed useful somehow, with similar useful things I had already been exposed to. Nowadays, I so fervently want to quickly dip through something, and have an AI or a bunch of enslaved social network users do most of it for me. "If you want something done right, do it yourself," goes right out the window. Trying to be thorough now gives me chest contractions, amnesia, etc etc . The moronism seems too strong for me. This is a huge part of why I make so many bugs when coding, and it gives my other personality, the one planning what bugs to make, so much space to act in. Security reviews are ridiculous now: I add and hide more vulnerabilities than I address. But I'll be sure to address one, because I'm trying to! And then you trust me! It's so bad it's hilarious, like everything else. Another thing that gets much harder with this issue is things like optimization and creative hacks. I used to read all my APIs just like those chip specs, from front to back, and pick the very best solutions for every problem I encountered. Similarly language specifications. Now, like any good influenced person, I only easily see tiny things that engage my influence, and everything else takes great effort and raises my triggers. Often I call this blindness, because I literally do not see physical visual things right in front of my face. I've been dealing with that for years. But suddenly it occurred to me that _calling it out_ in this way could give me an avenue to work on it. And then I see how it describes so many of my issues. It's a really basic one, that I can engage almost anywhere. What tasks, I wonder, are really conducive to practicing thoroughness? Simply the act of methodically engaging and including every part of something, maybe in a software context, and maybe sidestepping things like working memory challenges a little.

Over the past year, several meltdowns in the crypto market have wiped out trillions in value, including another huge crash last week. We are concerned that SoFi’s continued nonbank digital asset trading activities pose risks to consumers and safety and soundness risks to your institution. In February 2022, SoFi completed its acquisition of Golden Pacific Bancorp, a bank holding company (BHC) and its subsidiary Golden Pacific Bank, a national bank.1 As part of that transaction, SoFi received approval from the Federal Reserve to become a BHC and elected to be treated as a financial holding company (FHC) subject to consolidated supervision by the Federal Reserve.2 Additionally, SoFi received a conditional approval from the Office of the Comptroller of the Currency (OCC) to create a full-service national bank subsidiary insured by the Federal Deposit Insurance Corporation (FDIC).3 Following its conversion to a BHC, SoFi continues to operate a nonbank subsidiary called SoFi Digital Assets, an exchange for retail investors to buy and sell digital assets. In its letter dated January 18, 2022, granting approval, the Federal Reserve noted that “SoFi is currently engaged in crypto-asset related activities that the Board has not found to be permissible” for a BHC or an FHC. SoFi’s most recent annual report states that these impermissible activities are conducted by SoFi Digital Assets.4 Under the January 18, 2022 letter, SoFi has two years to either divest SoFi Digital Assets or conform its activities to the law, with the potential for up to three one-year extensions in the Federal Reserve’s discretion. During this conformance period, SoFi has committed not to “expand [its] impermissible activities,” except as specifically authorized by law. Specifically, SoFi has committed not to increase the “types of products and services offered” and the “established risk limits for total customer digital assets maintained in wallets that are accessible online . . . or held on balance sheet.” In addition, the OCC’s conditional approval restricts SoFi’s national bank subsidiary from conducting “any crypto-asset activities or services” without prior regulatory approval. We are concerned that SoFi’s continued impermissible digital asset activities demonstrate a failure to take seriously its regulatory commitments and to adhere to its obligations. First, SoFi’s apparent expansion of its digital asset services raises questions about progress towards meeting conformance commitments by January 2024. Two months after receiving approval to become a BHC, SoFi announced a new service allowing customers of its national bank to invest part of every direct deposit into digital assets with no fees. The company publicly billed this service as “the latest expansion of SoFi’s offerings to make it simpler to get started with cryptocurrency investing.”5 Second, SoFi’s facilitation of customer digital asset trading and holding digital assets on-balance sheet raises questions about the appropriate calculation of capital requirements. Under current capital rules, the capital treatment of these digital assets follows their accounting treatment rather than capital standards tailored to the risks of this particular asset class. While digital assets can pose the same risks as traditional financial assets, the recent market crash has highlighted concerning credit, market, liquidity, and operational risks associated with digital assets. Appropriate capital treatment is important because taxpayers could be on the hook if crypto- related exposures at SoFi Digital Assets ultimately require its parent BHC or affiliated national bank to seek emergency liquidity or other financial assistance from the Federal Reserve or FDIC. Third, SoFi’s standards for choosing which digital assets to offer its customers for trading raises investor protection concerns. According to criteria listed on SoFi’s website, the company’s policy is to list assets that “align with SoFi’s values, such as promoting financial inclusion and economic freedom.”6 But SoFi’s own investor protection materials posted on its website warn customers that at least one token listed on SoFi Digital Assets is “a crypto pump-and-dump” hazard with “no special use case or features” and that “[it] might be among the most high-risk endeavors an investor can take.”7 At the time SoFi issued this warning, the company had been offering this asset for several months and still offers it today. Facilitating retail sales of an investment product that SoFi has identified as a fraud and susceptible to market manipulation is incompatible with fundamental principles of investor protection and safety and soundness. Accordingly, we ask that you reply to the following questions no later than December 8, 2022: 1. Describe SoFi’s policies and procedures for: a. Determining which digital assets to offer and sell through SoFi Digital Assets. b. Ensuring that digital asset purchases and sales are conducted in compliance with applicable laws and regulations. c. Identifying any potential conflicts of interest and how those conflicts should be addressed. d. Monitoring customer complaints and their resolution. 2. How has SoFi determined the appropriate credit, market, and operational risk capital requirements for digital asset exposures, including customer digital assets and digital assets held on SoFi’s balance sheet? 3. Does SoFi Digital Assets offer any securities for purchase or sale? If so, how do SoFi Digital Asset’s existing registrations and licenses provide authorization to operate a platform for buying and selling those securities? 4. Describe SoFi’s plan to conform its digital asset trading activities to the BHC Act and Regulation Y by January 2024. How have the policies and offerings described in questions 1-3 changed, if at all, since January 18, 2022?
