Ed Markey’s (D-Mass.) little-known 3D Printed Gun Safety Act (S. 2319) would criminalize sharing firearm schematics for 3D printers online. 3D printing describes a process that allows people to “print” 3D models for various items. These models range from small tools, art projects, and shapes up to functional firearms. Critics of the practice have called these 3D-printed firearms “ghost guns” because they lack serial numbers and are difficult for law enforcement to trace. Despite their relative novelty, 3D-printed firearms have a rich legal history. In 2018, Congress passed the Export Control Reform Act (ECRA), a foreign policy bill designed to restrict enemies’ access to U.S.-made munitions. In March 2020, 22 states argued that 3D firearm schematics violated ECRA because they were accessible to foreign enemies. They brought suit against Defense Distributed (D.D.), a firm that provided schematics for 3D firearms. The plaintiffs argued that these schematics would cause them “irreparable injury.” Seattle District Judge Robert Lasnik agreed and issued an injunction against D.D. (pdf). The Ninth Circuit Court of Appeals heard the case again this year on Apr. 27. The panel concluded in a split decision that courts had no say in the matter, asserting that “Congress expressly precluded judicial review … here,” and overturned the injunction against D.D. (pdf). After this decision, the Justice Department proposed new regulations on 3D-printed guns. First, retailers would be required to run a background check on customers before selling kits containing necessary materials to print a firearm. Second, kits would be required to include a serial number on the frame or the receiver to make them more traceable. Finally, firearms dealers would be mandated to add a serial number to any guns they bought that did not have one. Markey’s S.2319 would concretize federal rules against the distribution of 3D gun files. The bill alleges that these schematics “increase the risk that … felons, domestic abusers, and other people prohibited from possessing firearms under Federal law, will obtain a firearm through 3D printing.” Because these 3D guns are not traceable, S.2319 says, they are appealing to criminals. S.2319 goes on to warn that such schematics “threaten to undermine the entire Federal firearms regulatory scheme and to endanger public safety and national security.” To address this alleged risk, the bill would make it “unlawful for any person to intentionally distribute … code that can automatically program a 3-dimensional printer or similar device to produce a firearm or complete a firearm from an unfinished frame or receiver.” Sen. Robert Menendez (D-N.J.) joined Markey in introducing the bill in the Senate. In a press release, Markey said of the bill: “With no background check required, untraceable and undetectable 3D printed guns serve as the ultimate gun-acquisition loophole. With the click of a mouse, anyone can download a computer file and use a 3D printer to manufacture a semi-automatic weapon. We cannot allow the online availability of downloadable firearms to add fuel to the fire that already is a massive gun violence public safety crisis.” Menendez expressed the same concerns, saying: “With the click of a mouse, anyone with an internet connection and a 3D printer essentially has a license to print, shoot and kill. Undetectable and untraceable 3D-printed guns allow criminals to circumvent law enforcement and commit crimes. That’s why we must close the ‘3D Gun Loophole’ that allows dangerous individuals to exploit gaps in existing law to manufacture firearms at home they cannot otherwise legally obtain.” s.2319 currently has 27 Democrat co-sponsors in the Senate. As of Monday, it remains in the Judiciary Committee. Still, with so many sponsors in the Senate, it is possible that Democrats may try to move the little-known bill out of committee for floor debate at some point. Even with the numerical Democratic majority, it would face a tough battle. Earlier this year, moderate Sen. Joe Manchin (D-W. Va.) said that he opposed Democratic gun control legislation in the House. If Manchin were to defect and join Republicans, then the bill would not pass without a Republican taking Manchin’s place and joining Democrats. However, passing Congress would only be the first step for S.2319. Afterward, it would doubtless face legal challenges from D.D. and gun rights advocacy groups like Gun Owners of America. In an interview with The Epoch Times, a spokesman for the Libertarian Party criticized the bill as impractical. He asked, “How would [the government] even enforce this law?” Later, he answered his own question, saying that “It would require Soviet- and CCP- levels of control [over citizens’ lives].” He also referenced litigation revolving around the issue of 3D schematics and doubted in the wake of this litigation that the bill could survive the courts. He referenced several cases and government settlements revolving around the issue. In August 2017, D.D. sued the State Department and asked the U.S. Supreme Court to hear their case against it. D.D. claimed that the State Department barring their right to distribute 3D schematics online constituted a violation of the First Amendment. Though the Supreme Court declined to hear the case, the State Department eventually reached a settlement with D.D. that gave the firm a license to publish the schematics and a cash payment of $40,000. Heather Nauert, a spokesman for the State Department, said in a press conference that the agency agreed to this decision because “We were informed that we … have likely lost this case in court … on First Amendment grounds.” In 1996, the Ninth Circuit Appellate Court ruled that source code was protected under the First Amendment (Bernstein v. U.S.). Because schematics like those provided by D.D. are a type of source code, standing U.S. law would prohibit restrictions like those found in S.2319. Thus, the law would raise criticisms as a violation of the First Amendment. And indeed, the law’s authors had a preconception of this risk. The final clause in Sec. 3 of the bill says that “by making illegal the distribution of certain computer code that can be used … [to] create firearms … Congress seeks not to regulate the rights of computer programmers under the First Amendment to the Constitution of the United States, but rather to curb the pernicious effects of untraceable … firearms.” Though the Supreme Court has refused to take the case in the past, it’s almost inevitable that S.2319 would go before the highest court if this legislation were passed. The result would be a huge landmark for gun control advocates if the Supreme Court upheld the law and a huge landmark for gun rights groups if the law were struck down. Either way, the legislation will have long-lasting national consequences if it is passed by Congress and signed into law.

I'm 28 years old. I grew up with Liberal baby-boomer parents and am a product of the early 2000s. I had school shooter drills in high school, bomb threats, and more. I am staunchly pro-gun. Many more people my age are as well. Interestingly, younger people are increasingly opposed to gun control, with the percentage of people under 30 that support stricter gun laws dropping from 65% to 45% since 2018. Gun owners are incredibly diverse. Young and old, people of all cultures, races, and political opinions own firearms. I'm not sure if there's anything that supersedes cultural and political divides, like the right to own a gun. And if the recent surge in gun buying (read: here & here) has shown us anything, when the chips are down, and it's time to take self-defense seriously- people who were once opposed to guns buy guns. Now, you probably already know this but March for Our Lives is not a grassroots organization. Major million-dollar donations almost entirely fund it. Only 0.5% of their entire revenue is from donations totaling less than $5,000. Some real journalists looked at the group's 990 tax form showing that out of the $18.6M that March for Our Lives collected in donations during 2018, $17.8M came from about 74 people donating between $5000.00 and $3,504,717.00. So, David Hogg would like us to believe that there's some army of young progressive anti-gun voters out there looking to wipe away these evil old boomers (who are some of the most prominent supporters of gun control, ironically). Yet, his entire organization is mainly supported by 78 wealthy donors. (If you dive into the data, 36 donors made donations between $100,000 and $3.5M, so maybe it's just 36 people who support Hogg). On Wednesday, the Supreme Court will take up arguably the oldest and most controversial right in our history. New York State Rifle Association v. Bruen is the first major gun rights case in over ten years to come before the Supreme Court and it has the makings of a major gun rights victory in the making. The case concerns concealed-carry restrictions under N.Y. Penal Law § 400.00(2)(f) that require a showing of “proper cause.” Lower courts have upheld the New York law, but there are ample constitutional concerns over its vague standard, such as showing that you are “of good moral character.” New York wants to exercise discretion in deciding who needs to carry guns in public while gun owners believe that the law flips the constitutional presumption in favor of such a right. There are few constitutional rights that have been debated so long in this country as gun rights. Indeed, before other Englishmen were given a written guarantee of the right to bear arms, colonists in Virginia in 1607 were given such a written guarantee by the Crown. Since that time, the right to bear arms has been an engrained part of our culture and ultimately our Constitution. Despite that history, the meaning of the right has remained the subject of heated debate. That is evident from the fact that it was not until 2008 that the Supreme Court finally recognized the right to bear arms as an individual right in District of Columbia v. Heller. Two years after Heller, in McDonald v. City of Chicago, the court ruled that this right applied against the states. This is actually the second time in two years that the New York State Rifle Association has come knocking on the door of the Supreme Court. The Association previously challenged a New York law that imposed stringent conditions on the ability of gun owners to even transport their guns outside of their homes. The law was viewed by some of us as unconstitutional under existing case law, but New York politicians insisted that it would be defended all the way up to the Supreme Court. However, when the Court called their bluff and accepted the case, those politicians quickly changed the law and pulled the case before the Court could rule. The bait-and-switch incensed members of the Court who delayed in the dismissal of the case. Justices Samuel Alito, Neil Gorsuch and Clarence Thomas specifically called out New York for “manipulating” the docket by withdrawing an unconstitutional law just before a final opinion. Justice Brett Kavanaugh joined in the condemnation and added menacingly that “some federal and state courts may not be properly applying Heller and McDonald. The Court should address that issue soon, perhaps in one of the several Second Amendment cases with petitions for certiorari now pending before the Court.” They ultimately did precisely that and took another case by the very same plaintiffs: the New York State Rifle Association. The current court membership is arguably the strongest Second Amendment bench in decades. That includes Justice Amy Coney Barrett, who wrote a strong defense of the Second Amendment defense as an appellate judge. While it is always dangerous to predict outcomes before the Court, this case was accepted with a likely intent to reverse the United States Court of Appeals for the Second Circuit (which also upheld the earlier restrictive law). With lower courts chipping away at its prior precedent, the Court seems poised to push back with a case that brings greater clarity and support for the right to bear guns in public. Many Second Amendment advocates are encouraging the Court to pull back on language from Heller that has been cited mantra-like by lower courts limiting the scope of this right. Many point to the court’s statement in Heller, which acknowledged that “like most rights, the right secured by the Second Amendment is not unlimited.” It then listed possible “sensitive places” for denying permits to former felons. The Court is likely to continue to recognize reasonable limitations, including possibly some location-based limits. However, it may create a clear presumption in favor of law-bidding citizens to bear arms outside of the home. The natural default under the Second Amendment in favor of gun owners is likely to be strengthened. The showdown with New York and the Second Circuit in that sense was merely delayed, but not forgotten by the Court. Ironically, the earlier law would have presented a narrower platform for reconsidering the Second Amendment. By gaming the system a year ago, New York may have delivered a far greater opportunity for Second Amendment advocates in the case. Of course, the Court could have accepted the case to simply amplify its agreement with the Second Circuit, but I would not count on it. It is like the scene in Braveheart when William Wallace said that he was going to “pick a fight” with the British when others were looking for a compromise. That came as little surprise to his main lieutenant Hamish who shrugged and added “Well, we didn’t get dressed up for nothing.”

If you haven't heard yet, Firearms Policy Coalition has filed what may be one of the most critical petitions for writ of certiorari for Marylanders and possibly gun owners in general in the case Bianchi v. Frosh. The case itself centers around the Maryland "Assault Weapons Ban" (AWB), also known as SB281 or the Firearms Safety Act of 2013. But before we dive into the law itself, let's look at the question being proposed to the Supreme Court in this writ of certiorari. The question presented is: "Whether the Constitution allows the government to prohibit law-abiding, responsible citizens from protecting themselves, their families, and their homes with a type of "Arms" that are in common use for lawful purposes?" The way this question is asked, we can see that if decided in favor of gun owners, the overturning of the Maryland AWB would be an unprecedented victory for gun owners nationwide. A Repudiation of assault weapon bans would free states like California, Massachusetts, New York, and New Jersey from their tyrannical state governments who've imposed their versions of this "Assault Weapon Ban." FPC's Adam Kraut affirmed that position saying, "This case presents the Court with an ideal vehicle to both address the scope of protected arms and constitutionally infirm analysis applied by these recalcitrant lower courts." The petition correctly describes the term "Assault Weapons" as a "pejorative and inaccurate label for a category of common semi-automatic firearms." Then quoting directly from Heller goes on to describe those same firearms as "in common use" and "typically possessed by law-abiding citizens for lawful purposes." Maryland's AWB is an assortment of inconsistent rules and regulations thought up by bureaucrats in Annapolis who have little understanding of firearms they seek to regulate. A few examples of inconsistencies: AK pattern rifle chambered in 7.62x39? Banned. AK pattern rifle chambered in 5.45x39? Good to go. AK Pistol in 7.62x39? Good to go. The only difference between the banned rifle and pistol? The stock. It also bans the AR15 and other "Scary" looking rifles but allows AR15s that conform to a Heavy Barrel Profile, or HBAR. It also allows for rifles that are functionally identical to the AR15, like the Ruger Mini 14. Ultimately, we won't know if the Supreme Court will hear the case until sometime in 2022, as The Supreme Court will hear it in their 2022 session. But the chances are good for the Court to take this case up. Many of the Justices have signaled that they're ready to hear 2nd Amendment cases. If the recent NYSRPA v. Bruen is any indication, we will likely see them tackle more gun rights issues that have far-reaching implications. Also, the makeup of the Court has changed in recent years. With the addition of Amy Comey Barrett replacing Ruth Bader Ginsburg, the Court has a solid conservative majority. As lower court judges, Justice Barrett and Justice Kavanaugh signaled they think courts need to rethink the framework used to often measure how gun regulations are evaluated. This framework is known as "Intermediate Scrutiny." When intermediate scrutiny is applied, a law has more of a chance to survive legal challenges because the government must prove only that it is "substantially related to an important government interest." This intermediate scrutiny clause is what has kept not only the Maryland Assault Weapon ban in place but many other AWBs nationwide. If the Justices are looking for a case that has far-reaching consequences for the 2nd Amendment and the process by which states uphold these unconstitutional laws, they need look no further than Bianchi v. Frost. This is why I posed the question: "Is this the beginning of the end for gun control?" In our coverage of gun control issues over the past year, we've seen a clear pathway that the anti-gun lobby is taking. Using the NFA, 1968 GCA, FOPA, and other gun control laws on the books, they've managed to ban Bump Stocks and inch closer and closer to regulating semi-automatic firearms under the NFA or outright ban them. The letter has caused the company to shut down its operation. “ATF has held that kits which include all components necessary to produce a functional firearm, including the jig or template used to finish the unfinished frame or receiver, the slide assembly, and the necessary components to complete the frame or receiver are themselves properly classified as firearms under the Gun Control Act,” the letter says. “Specifically, these kits are a weapon that may be readily converted to expel a projectile by the action of an explosive. These kits are firearms under the gun Control Act and have always been firearms pursuant to statute.” For years, the ATF has provided guidance on the definition of a gun. Those who sell parts such as 80 percent receivers do not need a Federal Firearms License. But the letter shows the ATF has changed its mind and is following the new regulation before it has gone into effect. “Those engaged in the business of selling these complete kits, as your company does, are in fact engaged in the business of dealing firearms,” the letter says. “Further, selling the necessary components to produce a functional firearm to the same person through multiple purchases or structure to transactions at different times instead of a single sale is equivalent to selling the complete kit to the customer. That is, the complete set of component parts necessary to create a firearm need not be packaged or sold in a single container or a single transaction in order to be considered a firearm. These piecemeal sales circumvent requirements of the Gun Control Act and are unlawful.” Part for a homemade gun as pictured in the 2013 ATF Technical Bulletin, in which it was defined as “not a firearm.” A new rule will require a background check to buy a part like this, and special licensing to sell it. (ATF) JSD Supply has filed a case in the U.S. District Court against ATF and the U.S. Department of Justice, seeking an injunction to remain open. The court filing says the ATF has recognized and expressly sanctioned, the unregulated sale of every single product that JSD Supply offers for sale. “ATF has specifically and repeatedly explained that firearm parts such as barrels, triggers and springs are not firearms under federal statutory law including the Gun Control Act,” the company’s complaint says. The ATF also has specifically and repeatedly determined that the 80 percent frames and receivers which the company sells are not firearms under the act and are entirely unregulated by the ATF. “This court’s intervention to protect the firearms industry and gun owners is necessary to reign in a branch of the federal government that is acting without any legal authority, and return the constitutional lawmaking power to the Congress, the only branch of government to which it was entrusted by Article I of the U.S. Constitution,” the complaint says. This appears to be the first U.S. case of a company receiving such a letter, but another company in Missouri has now been told by the ATF to stop selling their products, according to Gun Owners of America. “JSD Supply was just the first domino to fall in the ATF’s latest unwarranted action. Frustratingly, we have confirmed at least one additional company forced to halt sales and we expect more to follow,” Erich Pratt, senior vice president of Gun Owners of America (GOA) said in a statement. “Make no mistake, this is the beginning of a political crusade against homemade firearms. Forcing small businesses across the country to close their doors with no legal authority to do so, is wrong and a blatant abuse of power,” Pratt said. The problem for them is that ever since the Obama era they have consistently hit a brick wall in terms of convincing the general public to give another inch of ground when it comes to gun control. To be sure, there are many reasons for this that coincide. First, the credit crash of 2008 opened many people’s eyes to the possibility that the economic systems we take for granted today could disappear tomorrow. Gun rights were no longer a matter of “tradition,” but a matter of necessity. If the system breaks down and emergency services are overwhelmed or disappear then the only person you can rely on to protect your family is you. Mortal realities always win over emotional and reactionary demands. In other words, the benefits of individual self protection greatly outweigh any potential risks of criminality or abuse. Second, the advent of the covid mandates, lockdowns and the blatant attempts to implement vaccine passport tyranny upon half the population of this country yet again reinforced the idea that gun rights are more important than ever. Without the unified refusal to comply by conservatives and some moderate Americans, it is highly likely that our nation would be in the same situation as China is right now – A pointless cycle of lockdowns, authoritarian denial of basic services for people that refuse to submit to a highly experimental mRNA vaccine, and even worse supply chain disruptions and financial instability than we already have. Make no mistake, the reason the US is mostly free from these draconian conditions today is because of the continued existence of the 2nd Amendment and an armed citizenry. Without these things, there is no longer any obstacle to enforcing whatever unconstitutional provisions the establishment wants. Third, with the advent of the BLM riots, inflationary pressures and rising crime rates, there has been a renewed interest in gun ownership in the US among normies. It’s not just a conservative trend, many democrats have suddenly taken an interest also. There is very little chance that increased gun restrictions are going to happen with the approval of the public. The only way it could even be attempted is through executive order, and many millions of Americans will simply say ‘no’, just as they did with the vaccine passports. And, let’s be clear about what is really going on: The intention of political elites and the left is not “reasonable gun control.” Their purpose is indeed confiscation. Incrementalism is the name of the game. Lets not forget what we saw with the covid passports – At first they claimed that there were no plans to institute anything like a vaccine passport system. They said this was “conspiracy theory.” Then, not more than a year later Biden tried to enforce proof of vaccination through executive order. Suddenly, it wasn’t conspiracy theory anymore. The same strategy has been attempted with gun rights in the past, and they will try to do it again. As with every other Western nation that has restricted gun ownership down to almost nothing, they start with the “scary” semi-auto weapons and work their way down until you have nothing left. Or, until only people with considerable money have the ability to purchase a firearm (which is the case through most of Europe). I suspect that leftists are not fully opposed to the idea of gun ownership as they often pretend to be. I think they would actually like to retain their own guns if possible, they just don’t want people like you and I to have them. Selective gun confiscation would be their ideal, which is the same exact strategy used by the Nazis, who selectively outlawed gun ownership for Jewish citizens and anyone politically opposed to the Third Reich but let all other Germans keep their weapons. I would note that whenever gun crimes and mass murders are committed by people that are ideologically opposed to conservatives, the media and leftists often conveniently stop caring about taking action. They only seem to care when the crime can be associated with their political enemies. We all know that leftists constantly argue that conservatives are inherently dangerous. It only takes one more step for them to claim that conservative thought is in itself a “mental illness” and that our guns should be taken by default. But let’s talk about REAL mental illness for a moment, shall we? Let’s talk about recent active shooters like Payton Gendron with bizarre political and ideological beliefs that have nothing to do with conservative principles. Democrats like AOC and Chuck Schumer immediately tried to link Gendron, the Buffalo grocery store shooter, to conservatives and the Republican party. Yet, in only a few days time they were suddenly silent about the whole event and the media was oddly quiet. But why? As it turns out, Gendron’s philosophies were entirely socialist, with tinges of fascism and communism within the same framework. In fact, Gendron stated on multiple occasions that he hated conservatives and identified himself as an “eco-fascist.” He also had a history of reports concerning his mental health and safety. The media’s focus on “replacement theory” was a clear distraction from the real issue at hand. Their assertion was that if you are critical of illegal immigration, then you are automatically a racist and share an ideological boat with people like Payton Gendron. But then, their narrative fell apart when it became obvious that Gendron was actually anti-conservative. In the case of Salvador Ramos, details are still emerging about the Texas school shooter and his affiliations, but some information has been leaked despite the media’s quick move to control the narrative. For example, Ramos is not the white conservative monster the leftists need to fulfill their narrative requirements. Photos are also in circulation allegedly taken from his social media accounts which suggest he was transgendered and identified as “they/them.” I’ll stress here though that his social media accounts have been completely scrubbed and right now there is no way to confirm that this claim is true. Why his accounts were removed so quickly is not clear, but surely we will know more in the next couple of days. Leftists are swiftly moving to refute any possibility that Ramos was transgendered; maybe they are right, maybe not. They were also very quick to deny that Darrell Brooks Jr., the mass killer that ran down a parade of people with his car in Waukesha, WI, was a supporter of BLM. But, as it turned out initial reports by internet sleuths were correct. Suddenly, leftists were fielding arguments that he was “pushed” to commit the crime by “institutional racism.” If it turns out that Ramos did in fact identify as trans, then the media message will surely change once again. I have no doubt there will be a move to defend Ramos as a tragic figure, rather than a monster, and the blame will be placed on the state of Texas and their legislative actions to stop transgender policies from invading their public school system. The point is, there is no connection between gun rights supporters or conservatives and gun crime as leftists often claim. I can find just as many if not more incidences of mass murder perpetrated by leftists. The common thread between all of these killers and events is not guns or gun rights. Rather, it is blatant signs of mental illness and ideological zealotry. The media will not address this issue, and political puppets like Joe Biden will not address it either. Remember, the goal is gun confiscation, not public safety. If they actually cared about public safety then the mental illness connection would not be ignored. It is also important to point out that such tragedies are not limited to the US as some gun grabbers would like you to believe. Numerous mass murder incidences have taken place in Europe and Asia despite strict gun control. Many people have forgotten the mass murder of French citizens in Paris in November of 2015 by Islamic militants with AK47s. Or, how about the mass killing of Spanish citizens by Muslim terrorists in Barcelona in 2017 using a moving truck? Another factor which is almost always present during mass murder events is that most of them occur in gun free zones; places where carrying by law abiding citizens is denied or frowned upon. If we are going to address the issue of mass murder, we cannot ignore the commonalities of mental illness and gun free areas. The existence of guns in civilian hands is not the problem, if it were then mass murders would be a daily occurrence in every community in the country. However, this does not stop leftists from trying to exploit every tragedy as an opportunity to attack gun rights. They don’t care about nuance or honest solutions, they just want guns out of the hands of people they don’t like. The establishment also wants guns out of public hands for obvious reasons; it makes it much easier to erode other parts of the constitution when the 2nd Amendment is no longer a deterrent. Joe Biden argues that Americans “need to stand up to the gun lobby” in the wake of the Texas shooting, but the gun lobby has nothing to do with these events either. The biggest gun lobby in the US is the American people standing in defense of their freedoms, and they have committed no crime. At bottom, no gun owner or gun rights advocate is to blame for what happened in New York or Texas this past week. We didn’t commit the crimes, but the assertion is that we should be punished anyway. Well, I’m not going to allow that, and millions of conservatives and liberty minded people are not going to allow it. The appeal for new gun control measures and confiscation is aimed at the political left, and it is designed to make them feel better about the reality of tragedy. It’s a false silver bullet solution (no pun intended). It doesn’t address the real causes of mass violence, it only makes us more vulnerable to it. Frankly, I don’t care if leftists feel better, or feel like they accomplished something when they did not. I also know that increased gun control is exciting to many of them simply because it goes against the values of people they hate – i.e. conservatives. The fact is this: No matter what tragedy arises, our right to self defense overall is more important than appeasing the emotions of the moment. We won’t be giving up our guns. It’s not going to happen. They think we will capitulate given enough threats or enough pressure, and they are wrong. It will not end well for them. Other solutions need to be explored because the path to a revision or erasure of the 2nd Amendment, whether by legislation or by executive order, is nothing more than a path to civil war. It’s time to move on from the foolish notion that taking away guns from everyone (or just the people we disagree with politically) solves the underlying causes of mass murder. "A 19-year-old man shot an 18-year-old man in the parking lot of Spanish Fork High School before turning the gun on himself early Friday morning," Fox 13 reported at the time. "Police were called to the school parking lot near 99 N. 300 W. at about 2:30 a.m. where they found the 18-year-old had been shot in the upper arm." Certain anti-gun activist websites proved to be unreliable in terms of their relevant lists. Additionally, current regulations are in flux, as Louisiana and Ohio are now moving to allow armed teachers. It must be qualified, however, that remote learning in some school districts during the 2020 Covid response limits the generalizability of the analysis. According to Education Week, there were 10 school shooting incidents in 2020. Of those 10 cases, 3 incidents in states that permit armed teachers or school resource officers occurred outside of the school building itself (Florida, Ohio, Texas), and 4 incidents appear to be accidental discharges (California, Florida, Texas). (This is consistent with many — but not all —mass shooting reports in 2021 and 2022.) There was one case that took place inside a school gym in Dallas, Texas in January 2020. A 15-year-old shot and killed an 18-year-old after a brawl over a basketball game and also wounded a police officer. The teenage suspect later turned himself in. It is now 2022, and there are more cases than in 2020. The source cites 27 school shooting incidents already. The most startling case, of course, is that of the mass shooting at Robb Elementary School that killed 19 schoolchildren and two teachers. In the case of Uvalde, contrary to early misleading reports from the Texas Department of Public Safety, "there was no school resource officer on site" that confronted the mass shooter at Robb Elementary School. The Uvalde case highlights that there is a major difference between allowing a teacher or school resource officer to carry a gun and there actually being one on hand to stop a mass shooter should one attack. The deadly mass shooting incidents that appear to shock the public conscience the most are ones that occur in schools. According to the strictest technical definition, there have been thirteen deadly mass shootings in the United States since 1966. That doesn’t make the events any less tragic, but it does suggest that the solution does not lie in depriving law-abiding gun owners of personal defense firearms, but rather in identifying young persons prone to mass violence and ensuring there are responsible adults nearby who can put a quick end to a potential shooting rampage. While there are states that are now moving to implement stricter gun control laws in the aftermath of Uvalde — namely, Colorado, Connecticut, New York, and California — there are nearly as many states seeking to arm qualified teachers: Florida, Louisiana, and Ohio. Each list can be expected to grow in the weeks and months ahead. The worker, who was not identified, suffered a head injury after being pistol-whipped and knocked to the ground, Clark said. After managing to get back on his feet, the employee pulled his own legally owned pistol and fired three shots at Hickey, striking him twice, according to police. “Once Mr. Hickey was shot, he fled from the restaurant but only made it about 75 yards before collapsing on the street,” the official said. Authorities transported him to the hospital, but he died of his wounds. When Clark was asked in the interview how the worker was doing mentally after experiencing the fatal encounter, he told the anchor the worker “took it pretty hard.” “Of course, nobody wants to be in that situation and … he was doing his best to come out of it okay,” the police sergeant said. In recent years, the United States has seen overall crime increase after enjoying decades of generally declining crime. In particular, robberies, carjacking, burglaries, and theft, have increased over the past year or so. Clark told Fox News that Warner Robins, a city in Houston and Peach counties located in the central part of Georgia, has not necessarily seen an increase in crime, although the area did report “a fair share of crime,” including violent crime and theft. When asked to react to major cities reporting an increase in robberies and homicides in recent years, Clark blamed it on staff shortages, adding that it is hard for law enforcement to do their jobs efficiently nowadays. “It’s terrible, a lot of it has to do with, you know, officer shortages,” he told the network. “Everybody, including us, is dealing with this. Judge Roger Benitez said in a San Diego courtroom on Dec. 16 that he would soon issue an injunction halting part of a state law scheduled to take effect on Jan. 1, according to The Associated Press. The offending provision would require those who fight the state’s gun laws to pay the government’s legal fees should they lose in court and was heavily promoted by California Gov. Gavin Newsom, a Democrat with presidential ambitions. The case, filed in the U.S. District Court for the Southern District of California, is Miller v. Bonta, court file 22-cv-1446. The lawsuit is one of many now pending in courts across the country after the U.S. Supreme Court ruled this past June that individuals have a constitutional right to carry firearms in public for self-defense. The so-called loser-pays requirement would produce a “chilling effect” that would hinder state residents from suing to vindicate their legal rights because they would fear having to pay potentially huge lawyers’ tabs, Benitez said, agreeing with Second Amendment advocates. “I can’t think of anything more tyrannical,” said Benitez, who was appointed by former President George W. Bush. Benitez previously ruled against California laws targeting gun ownership. His defense of the Second Amendment has earned him the nickname “St. Benitez” among gun rights activists. In June 2021, the judge found that California’s Assault Weapons Control Act of 1989, which prohibited so-called assault weapons such as the popular AR-15 rifle in the state, ran afoul of the Second Amendment. Weeks later the U.S. Court of Appeals for the 9th Circuit put his ruling on hold. And in March 2019, Benitez found that the state’s ban on large-capacity magazines included in Proposition 63 was unconstitutional. In the case at hand, the judge said he would not prevent the rest of the statute from coming into force, leaving intact provisions that prohibit the sale of certain so-called assault weapons and a ban on guns lacking serial numbers. The California gun law relies on a novel enforcement mechanism inspired by a Texas law enacted last year that crowdsourced abortion enforcement, giving individuals the right to sue over alleged violations of the state’s fetal-heartbeat abortion law. The law allows, for example, for someone who helped a woman obtain an unlawful abortion by driving her to a clinic to be sued. Newsom argues the Texas abortion law is unconstitutional but says if the U.S. Supreme Court upholds it, then his state will rely on the same enforcement mechanism to target Second Amendment protections. The U.S. Supreme Court refused a request to block the Texas law and on Dec. 10, 2021, issued a complex procedural ruling in Whole Woman’s Health v. Jackson, remanding the case to a lower court. Then in June of this year, the high court overturned Roe v. Wade, the 1973 precedent that held abortion was a constitutional right, leading to a flurry of activity in state legislatures and legal challenges to abortion laws in courts across the nation. In court on Dec. 16, Benitez chided lawyers for the state of California who said the state does not intend to enforce the legal fees rules unless the Texas law survives legal scrutiny. “We’re not in a kindergarten sandbox. It’s not about, ‘Mommy he did this to me so I should be able to do this to him,’” Benitez reportedly said. The Epoch Times reached out repeatedly to both sides for comment over the weekend. Bradley Benbrook and Stephen Duvernay, attorneys for the California gun law challengers, and lawyers for the state, Elizabeth K. Watson and Thomas A. Willis, did not reply as of press time. The California Gun Rights Foundation, which is fighting the law, also did not reply to a request for comment. But lawyer Joshua Dale, who represents a San Diego area gun club that is involved in the lawsuit, told Benitez the law would put undue pressure on would-be litigants. “I’m terrified of this law,” Dale said in court, according to the AP. “It would be absolutely devastating to pay the state’s attorney fees. I’ve got kids. I’ve got a mortgage. I could never pay $50,000 or $100,000 without emptying my 401(k) account.”

In a Dec 23 hearing, Circuit Court Judge Robert Raschio said he would rule by Jan. 3 whether to lift a temporary restraining order (TRO) on the Oregon Ballot Measure 114 requirement that a background check be completed before a firearm can be sold or transferred. Earlier this month, Raschio issued a TRO on the measure’s permit-to-purchase provision and its ban on magazines that carry 10 or more rounds. Those TROs are still in place. Immergut had denied such relief to plaintiffs in one of four related cases. In his ruling, Raschio said the law violated the Oregon state constitution’s right to bear arms and that Oregonians would be “unable to lawfully purchase a firearm or bear a magazine capable of holding more than 10 rounds of ammunition in the State of Oregon.” The Oregon Department of Justice immediately filed a petition asking the Oregon Supreme Court to vacate the lower court’s decision. “We strongly disagree with the decision of the Harney County Circuit Court,” Oregon Attorney General Ellen Rosenblum wrote to the court. “Our mandamus petition to the Oregon Supreme Court gives our highest state court the opportunity to weigh in now and reverse the Harney County judge’s ruling.” The state Supreme Court refused to intervene. State Unprepared to Issue Permits On Dec. 13, Raschio heard arguments on the permit-to-purchase provision, which the state acknowledged was not ready to go. The state had declared that it needed until approximately Feb. 8 to implement that system. Lifting the order before the permitting system is ready would cause “irreparable harm to the constitutional right to bear arms,” he said. The judge continued the TRO for this provision. When the state notifies him in writing that it is prepared to roll out the new permitting program, he will schedule a hearing. The court then considered the ban on magazines that hold 10 rounds or more. The state argued that such firearms were not in “common use” when the Second Amendment was ratified. So, they are not protected. The state’s expert, Brian DeLay, associate professor of history at the University of California at Berkeley, testified that high-capacity firearms were an “experimental technology” and not commercially available when the Oregon Constitution was ratified. Experts for the plaintiffs testified that high-capacity firearms have existed since the 16th century. Lewis and Clark Carried High Capacity Firearm Isaac Botkin, the technical and education director at manufacturing company T-Rex Arms for more than a decade, described a long history of firearms capable of holding more than 10 rounds, the most famous being one carried by the Lewis and Clark Expedition. It was in 1804-06 that Capt. Meriwether Lewis and Lt. William Clark led the expedition to explore the Louisiana Purchase and the Pacific Northwest. “Meriwether Lewis carried a firearm that had the capability of 20 or 22 rounds that was quite effective,” he said. The state’s attorney argued that Botkin shouldn’t be allowed to make any “historical conclusions” on the history of guns, claiming that he is not an expert. The judge disagreed and allowed Botkin to continue. Plaintiff’s Attorney Tony Aiello Jr. argued that magazines that hold more than 10 rounds are standard for guns manufactured today. He said those guns are “essentially the same firearm, just modified by design and function,” as some of the nation’s earliest guns. Raschio asked whether magazine restrictions would “reasonably promote public safety by restraining a constitutional right to bear arms” as claimed in the ballot measure. Aiello argued that it would not, claiming that the ban would deny law-abiding Oregonians the ability to defend themselves while criminals continue to ignore the law. Background Check Provision Scrutinized Convinced that the ban would violate Oregonians’ rights under the state constitution, Raschio also extended the TRO on the magazine restriction. “Based upon the preliminary evidence, the result of BM 114 would be a near absolute prohibition on handguns and many other firearms with their magazines,” Raschio wrote. The Dec. 23 hearing focused primarily on the measure’s requirement that a background check is completed before a firearm can be sold or transferred. Oregon special Attorney General Harry B. Wilson argued that the completed background-check requirement would save lives, is constitutional, and wasn’t explicitly challenged by the plaintiffs. A licensed firearms dealer can legally deliver a purchased gun after three business days if the required federal background check is not complete—what gun control advocates call the “Charleston Loophole.” Measure 114 would end that by giving the state more time to complete background checks. Measure Offers No Guarantee of Expediency “Although a significant percentage of background checks are completed automatically within minutes, many require additional time,” Wilson wrote to the court. “As a result, in some instances, individuals with felony criminal histories can obtain a firearm because the transferer can deliver the firearm after three days and before the background check is complete.” Aiello argued that the federal law ensures a gun buyer doesn’t have to wait indefinitely. He claimed Measure 114 offers no guarantee that background checks will be processed promptly. “This is infringement because … they can slow-walk background checks or not do them whatsoever,” he said. Ironically, the hearing on background checks took place as Oregon had nearly 40,000 people waiting for their background checks to be completed. The adoption of Measure 114 has caused a spike in gun purchases, and the Oregon State Police haven’t been able to keep up. “While we are pleased that GOA’s suit has thrown sand in the gears of the state’s tyrannical and rabid effort to disarm the law-abiding, the reality is that the queue of people waiting for their property is growing and barely moving,” a spokesman for the Oregon Firearms Federation told The Epoch Times. “People’s rights are being denied right this minute.”

However, he was banned from returning to power in 2018 after he was convicted on charges of money laundering and corruption at the state-owned oil and petrol company, Petrobrás. He was subsequently sentenced to 12 years in prison following an investigation into the scheme. Throughout his time in prison, da Silva maintained his innocence and called the case against him politically motivated. His conviction was later overturned by the Supreme Court when seven of 11 justices agreed that he should be tried in the state in which he lives as opposed to the state in which he was accused. It is a well-known fact that ATF's NFA division consistently misses its own performance benchmarks and routinely sees wait times for ATF form approvals and tax stamps in the 300-400 day range. If 40 million firearms are added to that waitlist, it is logical to assume that gun owners forced to comply with this unconstitutional registration scheme may wait years in limbo. But don't despair! For those who are unfamiliar with this fight, President Obama attempted a similar executive order towards the end of his term in 2016. Obama attempted to expand the definition of gun "dealer" to: - Restrict private transfers of firearms under the guise of the so-called loopholes "online and at gun shows." - Prosecute those who sell even as many as one firearm unless they obtain a Federal Firearms License. - Punishing this otherwise lawful behavior with "up to five years in prison and fines up to $250,000." While Biden has just announced his executive order, we currently have no specifics on what that will entail. Obama's executive order gives us a look into the future of what this rulemaking could potentially look like. While the Biden administration may think this move is popular, the support for Universal Background Checks is fake. The fact is, most people who are polled in these anti-gun surveys don't fully understand what a Universal Background Check is, or that they're actually Universal Registration Checks. According to a survey of 1,000 people done by the Crime Prevention Research Center, 86% say they support background checks on all gun sales or transfers, but as soon as they're asked follow-up questions which explain how this would look as policy, support starts to drop. For example, when survey participants were asked a question with context on how the law would affect them, 44% now say they oppose Universal Background Checks, and only 42% say they support them. Universal Background Checks don't stop crime or criminals, instead they limit the ability of law-abiding citizens from being able to innocently transfer firearms to each other. The goal of President Biden's new backdoor universal background check scheme is to turn as many private citizens as possible who sell their guns into FFLs, restricting their ability to conduct private gun transfers without being recorded in the ATF's illegal national federal registry. Remember, the ATF already has a database of nearly one billion gun and gun owner records in their West Virginia facility. The U.S. Department of Justice (DOJ) is asking the Supreme Court to overturn an appeals court ruling that struck down a federal law preventing people under domestic violence-related restraining orders from having guns. The Biden administration asked in its new petition (pdf) for the high court to hear the case on a “highly expedited schedule” because of the “significant disruptive consequences” of the lower court’s ruling. The petition was reportedly filed with the court on March 17 but had not been docketed as of press time. The case comes as courts nationwide are playing catchup regarding the Supreme Court’s landmark June 2022 ruling in New York State Rifle and Pistol Association v. Bruen that held firearms restrictions must be deeply rooted in American history if they are to survive constitutional scrutiny. Senate Judiciary Committee chairman Dick Durbin (D-Ill.) said on March 15 that the Bruen ruling offers little guidance to lower courts on interpreting the decision, as Courthouse News Service reported. “The gun lobby saw Bruen as a landmark win, but it is a significant challenge for police, law enforcement, and the population of America when it comes to public safety,” Durbin said. The case involves Zackey Rahimi of Texas, who pled guilty to violating a 1994 federal law –Section 922(g)(8) of Title 18 of the U.S. Code— that prohibits a person who is subject to a domestic-violence restraining order from possessing a firearm. Rahimi was involved in five shooting incidents after the restraining order was entered against him in February 2020. But when the U.S. Court of Appeals for the 5th Circuit took up Rahimi’s case earlier this year, it overturned the law, finding it was no longer constitutional according to the principles laid down in Bruen. The government failed “to demonstrate that § 922(g)(8)’s restriction of the Second Amendment right fits within our Nation’s historical tradition of firearm regulation,” the panel stated. The ban on the possession of firearms by someone under a domestic violence-related restraining order “is an outlier that our ancestors would never have accepted.” U.S. Attorney General Merrick Garland said last month the DOJ would appeal the ruling but did not provide a timeline for doing so. “Nearly 30 years ago, Congress determined that a person who is subject to a court order that restrains him or her from threatening an intimate partner or child cannot lawfully possess a firearm,” Garland said in a Feb. 2 statement. “Whether analyzed through the lens of Supreme Court precedent, or of the text, history, and tradition of the Second Amendment, that statute is constitutional. Accordingly, the Department will seek further review of the Fifth Circuit’s contrary decision.” In the new petition, U.S. Solicitor General Elizabeth Prelogar argues that the appeals court erred. “In concluding that Section 922(g)(8) lacks adequate historical support, the Fifth Circuit missed the forest for the trees. The court overlooked the strong historical evidence supporting the general principle that the government may disarm dangerous individuals,” the document states. The court also “analyzed each historical statute in isolation and dismissed each one on the ground that it differed from Section 922(g)(8) in some way.” The 5th Circuit’s “mode of analysis was flawed.” Courts interpreting the Second Amendment have to “consider text, history, and tradition, [but] they should not focus on whether the law at issue has ‘a historical twin,’” the petition states, quoting from the Bruen decision. “This Court’s review is warranted because the Fifth Circuit held an important federal statute unconstitutional on its face,” the petition states. Report Reveals ATF Misappropriated $20 Million To Pay Bureaucrat Salaries https://twitter.com/GunOwners https://www.gunowners.org/ by Gun Owners of America A recent report from the U.S. Office of Special Counsel revealed that the ATF unlawfully paid agents more than $20 million in wrongful benefits using taxpayer funds. According to that report, ATF intentionally misclassified jobs as law enforcement positions and paid those employees benefits to which they were not entitled. The sum of the findings totaled about 20 million dollars over five years to 108 ATF employees. That's around 37 thousand dollars a year in salary and retirement benefits per employee. As detailed by the OSC's report, these actions were ATF leadership's standard operating procedure for many years. A quote from the report surmised that the actual cost could be much higher given that the unlawful job classifications had been common practice at ATF far longer than the five-year timeframe reviewed by investigators. In a 7-4 vote, the 9th Circuit stayed a Sept. 22 ruling by US District Judge Robert Benitez in San Diego, who found that the state's ban violated gun owners' rights to keep and bear arms under the 2nd Amendment. Benitez cited a 2022 decision by the US Supreme Court in New York State Rifle & Pistol Association v. Bruen, which requires that firearms restrictions be "consistent with this nation's historical tradition of firearm regulation." Following Benitez's decision, California AG Bob Bonta (D) moved to stay the decision, which the 9th Circuit's liberal majority quickly did. The Monday ruling applies to a long-running lawsuit brought by the California Rifle & Pistol Association as well as gun owners challenging the ban. "If a stay is denied, California will indisputably face an influx of large-capacity magazines like those used in mass shootings in California and elsewhere," wrote the 9th Circuit Democrat majority. Gavin Newsom said the move is “dangerous” and “puts the lives of Californians on the line,” adding, “We won’t stop working to defend our decades of progress on gun safety in our state.” The SB2 law was signed by Mr. Newsom, a Democrat, in September of last year. If you haven't heard yet, Firearms Policy Coalition has filed what may be one of the most critical petitions for writ of certiorari for Marylanders and possibly gun owners in general in the case Bianchi v. Frosh.

The case itself centers around the Maryland "Assault Weapons Ban" (AWB), also known as SB281 or the Firearms Safety Act of 2013.

But before we dive into the law itself, let's look at the question being proposed to the Supreme Court in this writ of certiorari. The question presented is: "Whether the Constitution allows the government to prohibit law-abiding, responsible citizens from protecting themselves, their families, and their homes with a type of "Arms" that are in common use for lawful purposes?"

The way this question is asked, we can see that if decided in favor of gun owners, the overturning of the Maryland AWB would be an unprecedented victory for gun owners nationwide. A Repudiation of assault weapon bans would free states like California, Massachusetts, New York, and New Jersey from their tyrannical state governments who've imposed their versions of this "Assault Weapon Ban." FPC's Adam Kraut affirmed that position saying, "This case presents the Court with an ideal vehicle to both address the scope of protected arms and constitutionally infirm analysis applied by these recalcitrant lower courts."

The petition correctly describes the term "Assault Weapons" as a "pejorative and inaccurate label for a category of common semi-automatic firearms." Then quoting directly from Heller goes on to describe those same firearms as "in common use" and "typically possessed by law-abiding citizens for lawful purposes."

Maryland's AWB is an assortment of inconsistent rules and regulations thought up by bureaucrats in Annapolis who have little understanding of firearms they seek to regulate. A few examples of inconsistencies: AK pattern rifle chambered in 7.62x39? Banned. AK pattern rifle chambered in 5.45x39? Good to go. AK Pistol in 7.62x39? Good to go. The only difference between the banned rifle and pistol? The stock.

It also bans the AR15 and other "Scary" looking rifles but allows AR15s that conform to a Heavy Barrel Profile, or HBAR. It also allows for rifles that are functionally identical to the AR15, like the Ruger Mini 14.

Ultimately, we won't know if the Supreme Court will hear the case until sometime in 2022, as The Supreme Court will hear it in their 2022 session. But the chances are good for the Court to take this case up. Many of the Justices have signaled that they're ready to hear 2nd Amendment cases. If the recent NYSRPA v. Bruen is any indication, we will likely see them tackle more gun rights issues that have far-reaching implications.

Also, the makeup of the Court has changed in recent years. With the addition of Amy Comey Barrett replacing Ruth Bader Ginsburg, the Court has a solid conservative majority. As lower court judges, Justice Barrett and Justice Kavanaugh signaled they think courts need to rethink the framework used to often measure how gun regulations are evaluated. This framework is known as "Intermediate Scrutiny."

When intermediate scrutiny is applied, a law has more of a chance to survive legal challenges because the government must prove only that it is "substantially related to an important government interest."

This intermediate scrutiny clause is what has kept not only the Maryland Assault Weapon ban in place but many other AWBs nationwide. If the Justices are looking for a case that has far-reaching consequences for the 2nd Amendment and the process by which states uphold these unconstitutional laws, they need look no further than Bianchi v. Frost.

This is why I posed the question: "Is this the beginning of the end for gun control?"

In our coverage of gun control issues over the past year, we've seen a clear pathway that the anti-gun lobby is taking. Using the NFA, 1968 GCA, FOPA, and other gun control laws on the books, they've managed to ban Bump Stocks and inch closer and closer to regulating semi-automatic firearms under the NFA or outright ban them. This Case, Bianchi v. Frost, would put a significant roadblock in front of that.

"We have to stop the flow of guns. We are removing thousands of guns off our streets, and it appears for every gun we’ve removed from the street, five are coming in. All of this follows an emotional speech from Hizzoner on Friday evening, where he lamented that "there are no gun manufacturers in New York Cit. We don't make guns here," but somehow, so many still find their way into the hands of criminals who reside in the Big Apple. “We need Washington to join us and act now to stop the flow of guns in New York City and cities like New York.” Lashawn McNeil, the 47-year-old man who allegedly shot the pair of NYPD cops Friday evening, used a Glock .45 with a high-capacity ammunition magazine that was stolen from Baltimore in 2017, the NYPD said. Adams wasn't the only New York Democrat to pledge a crackdown on gun trafficking and related crime. Gov. Kathy Hochul claimed in a statement this weekend that she had "tripled" funding to stop guns coming into the Empire State. The new requirements - the first of their kind in the United States - disproportionately punishes low-income residents who wish to defend themselves against criminals who will ignore the new financial burden. Fighting the law is the Firearm Policy Coalition, which called it "burdensome, unconstitutional, and prohibited by California law" to law-abiding citizens who own firearms. "Since San Jose's recalcitrant City Council members don't believe that the United States Constitution applies to them or their citizens, Firearms Policy Coalition and our members are now committed to fight the City's outrageous and offensive policies in federal litigation and take every possible action to block their enforcement," said the group. The move follows June 2021 legislation requiring the video taping of all legal gun purchases. San Jose Mayor Sam Liccardo said at a Monday press conference that "San Jose has an opportunity to become a model for the rest of the nation to invest in proven strategies to reduce gun violence, domestic violence and suicide and the many other preventable harms from firearms in our communities." Having liability insurance would encourage people in the 5,500 households in San Jose who legally own at least one registered gun to have gun safes, install trigger locks and take gun safety classes, Liccardo said. The liability insurance will cover losses or damages resulting from any negligent or accidental use of the firearm, including death, injury, or property damage, according to the ordinance. If a gun is stolen or lost, the owner of the firearm would be considered liable until the theft or loss is reported to authorities. -ABC7 The law won't apply to current or retired law enforcement officers, those with a license to carry, or anyone who simply ignores it.

National Concealed Carry? If you're unaware of the most recent 2nd amendment case in the supreme court, let me give you a quick refresher. NYSRPA v. Bruen deals with the "may-issue" scheme plaguing liberal states. Essentially the government decides whether you can carry a firearm based on specific criteria or an atypical need from the general population. Suspiciously missing from this criteria is "self-defense." Maryland has a scheme very similar to New York's. The Machine Gun Nest is a Maryland-based company, and I grew up in Maryland. I recently received my concealed carry permit from Maryland State Police after submitting to an intensive background check which required me to prove (with tax forms, bank account statements, and more) that I was indeed a business owner. If I had merely said that I was a humble tax-paying, law-abiding citizen who was concerned about their safety on my evening walks through Baltimore city, I would have denied that permit. See the issue here? Well, so does the Supreme Court. Oral Arguments for NYSRPA v. Bruen took place on Nov. 3rd, and afterward, it seemed like the majority of Justices were staunchly on the 2nd amendment side. We'll have to wait until summer 2022 to get the verdict, but it appears that the State of New York has seen the future and has already started crafting legislation to render a concealed carry permit useless. New York Bill A08684 is an apparent reaction to the almost certainty that the Supreme Court will rule New York's permitting scheme as unconstitutional. The bill itself states that no firearms can be possessed anywhere on "public" transportation (including rideshares, trains, and taxis), in restaurants, or anywhere where 15 or more people are gathered. While this bill may be depressing to read for the New Yorkers who are desperate for the ability to defend themselves, the evidence is clear that even the Government of New York seems to be confident that they're going to lose NYSRPA v. Bruen. What does this mean for the rest of the country? Well, it means the end of "may-issue" schemes, which means that all 50 states would switch to a shall-issue system. We saw a similar occurrence in 2017 when Washington DC lost in DC Circuit Court for the case Wrenn v. District of Columbia. If you want to carry a firearm in DC and complete the required training, you are guaranteed to receive a permit to carry a gun. Interestingly enough, DC Government did not appeal the case to the Supreme Court probably because they didn't want an NYSRPA v. Bruen situation on their hands. The firearms industry certainly is preparing for an explosion of concealed carry. We were at SHOT Show in Las Vegas and heard much talk about the case, especially from dealers and firearms instructors in more liberal states. In addition, many new products for 2022 are personal protection and carry focused, like Federal's new 30 Super Carry, S&W's new CSX handgun, and many more. So, what should we expect? Later this year, when the court announces their verdict, they also may decide to clear up a big problem in gun law right now. There's only been a handful of 2nd Amendment cases that the Supreme Court has ruled on. Because of this, 2nd Amendment law isn't exactly crystal clear to some courts. (How you could misinterpret "shall not be infringed is beyond me) The result of this uncertainty is that lower courts like the liberal-leaning 9th Circuit essentially rubber stamp unconstitutional gun control like assault weapon bans and more because the Supreme Court hasn't explicitly ruled on one way or another on an issue. NYSRPA v. Bruen may serve as an excellent opportunity for the Supreme Court to clear up some bad lower court rulings. At the very least, here in Maryland, we're expecting an explosion in concealed carry permits. To give you an example of the disparity between a free state and a liberal state, Maryland and Indiana have similar populations. Still, the percentage of residents with carrying permits in Maryland is 0.4%, while Indiana is 18%. That's a significant disparity, and this disparity has likely grown larger as the statistics on carry permits were last recorded in 2017. 2020 & 2021 saw a considerable rise in concealed carry permit applications at the rate of 10.5% growth in permit applications year over year. Needless to say. We're excited to be delivering some good news when it comes to gun law, but only time will tell what the Supreme Court has to say for NYSRPA v. Bruen. But if there's any indication of victory, it's when the blue state governments start to panic. That's clear from the pending legislation in New York. So, we're predicting a victory for the 2nd Amendment. The only thing yet to be shown is how far that victory will go.

It seems the fallout from the insanity of 2020 continues to stay in the public's mind. Even a year out from the panic buying craziness, riots, movement to defund the police, and the election of Joe Biden, Americans seem to have a new take on gun control. According to a new poll, 63% of Americans support enforcing current gun laws instead of passing new gun control into law. This change shouldn't be surprising for anyone who's lived through the past two years. With 2020 & 2021 bringing COVID, Lockdowns, panic buying, the massive BLM riots, and the movement to defund the police, it's no surprise that Americans are starting to oppose new gun control in more significant numbers. A statistic that has helped shape that polling data is that millions of Americans became first-time gun owners during the pandemic. I experienced this rush of new gun buyers at The Machine Gun Nest, where we became completely inundated with first-time gun buyers. Many of those buyers had no idea that firearms required a background check (and a wait time here in Maryland). This process was a rude awakening for many of these same first-time buyers that everything they had learned about firearms being "easier to buy than books" was all just corporate media lies. What's even more interesting is that the data changes come primarily from non-traditional gun owners, people who identify as political independents, and even Democrats. Recently there was a 15 point drop in support for strict gun control laws from independents, according to Gallup. Considering that 50% of all new gun owners in the past two years are women, and many more are minorities, it makes sense that attitudes are shifting. It's a drastic change compared to pre-pandemic thinking. Just a few years ago, in 2018, after the mass shooting in Parkland, FL, support for gun control was at its highest point, with 66% of the country supporting new gun control legislation. We also know that activist district attorneys like those in Philadelphia and other liberal cities often refuse to charge or prosecute criminals on firearms charges, leading to higher rates of violence in those same cities. In Philadelphia, out of 1,810 firearms cases in 2021 (that's more than 4 per day), 61.5% of cases were dismissed or withdrawn. Only 2.6% of those same cases (that's 47 total) were found guilty at trial. We at The Machine Gun Nest can speak from experience being in Maryland. Baltimore City is an example of these failed policies. It's no wonder with the failure even to prosecute violent criminals with gun crimes that Maryland residents are desperate to buy and carry firearms. It's also no wonder that the people of the United States, especially in these liberal jurisdictions, want the law enforced! Another significant movement creating conversation and awareness that may have contributed to this new poll is the number of counties that have become 2nd Amendment Sanctuaries. The 2nd Amendment Sanctuary movement first gained attention when, in early 2020, the Governor of Virginia moved to pass an "Assault Weapons Ban," among other gun control measures. This gun control push triggered a massive response from the citizenry of VA (one of the most armed states per capita in the country). It caused many of Virginia's counties to become 2nd Amendment Sanctuaries, where the local government refuses to enforce gun control laws. This idea became so popular that 62.5% of counties in the United States are now 2nd Amendment Sanctuaries. So why does all this matter? Well, the country's mood has shifted when it comes to firearms. This cultural change is reflected in government, where Democrats don't want to pursue gun control legislation whatsoever! A few days ago, Joe Biden marked the fourth anniversary of the mass shooting in Parkland, FL, by calling on Congress to pass new gun control legislation. But Democrats don't seem to be interested, as reported by The Hill – Democrats don't seem to feel that there's enough support for new gun control to push the legislation! Gun owners can take solace in the fact that, at least in Congress, the gun control agenda has stalled. This stalemate is, of course, why the Biden administration has been pushing gun control via executive fiat, using the ATF to circumvent the legislative process altogether. With hotly contested midterms and Presidential approval ratings plummeting, the Biden Administration will be looking for any scapegoat to rally their base back to vote. We've seen it recently with Biden trying to "rally around the flag" with the situation in Ukraine, and we know that gun control is food for the base so to speak. I'd expect Biden to announce that he's "solved the ghost gun issue" this spring when the ATF releases their new unconstitutional rules on frames and receivers. The flip side of the gun control agenda stalling at the Federal level is that States will then take the issue into their own hands. We currently see some of the most egregious local gun control pushes yet, with San Jose, CA, requiring that gun owners purchase liability insurance for their firearms and pay a fee, which will be donated to an anti-gun group! Meanwhile, in Boulder, Colorado, local legislators have entirely thrown out State Preemption to pass a city-level assault weapons ban, literally balkanizing the State of Colorado legally in the process. With the verdict for NYSRPA v Bruen on the horizon and many more legal battles ahead, 2022 will be a very interesting year for gun rights.
