It is counter-intuitive and counter-productive for someone who thinks the government engages in secrecy to have the government violate rights in a secret manner that cannot be contested because of legal complexity.

If the government engages in an action, it is popularly known, and it is popularly approved, it could be considered legitimate, but if it is done in secret, it may as well be mob rule.
