Even if the FBI knew about Heartbleed, they'd presumably want to use the
evidence they gathered from Lavabit to prosecute a case in an open
court. They couldn't use illegally gathered evidence in a criminal
trial. 

The NSA and CIA, on the other hand, are military rather than civilian.
They don't have to have trials. They have Guantanamo instead.
