Wrong. See that phrase 'private financial gain'? 

That means that any(!!!) activity, private or commercial, which reduces
the cash flow INTO the corporation is a legitimate target. So simply
talking about it is most definitely a crime. So, while in this case they
may not have decided to go this route, the route is still there.
