I don't need an editor, particularly one who thinks two things are equivalent only in a smirking sense. I doubt this is a situation one should implicitly trust the law at its word. There have been supreme court cases on who can make final decisions on publication, but those don't apply because they are inconvenient and don't deal with exactly the same matter.
