According to Bunnie one of the major blocks is liability if a commercial provider of open CPUs also provides open pre-built code if its found there were undetected flaws, especially if those flaws can't be fixed without spinning up new chips. Sounds like more FUD to keep such projects down. Read up on legal liability disclaimers, signed voluntary contracts, etc. And wtf is "open pre-built code"? "built" binary? That's not open. Besides, #OpenCPU on #OpenFABS will have #OpenAudit #OpenCrowdReview #OpenBughunt etc models integrated throughout process from sand to power on. Ever read an Intel, AMD, Qualcomm, ARM, Power... errata sheet? Hundreds of "won't fix" can't fix. And that's just the errata the public found and the companies bothered telling you about, and they "legally" happily refuse to give you such a free newspun chip. Less FUD, MOAR DO. Get rid of the legacy system.
