Please accept this letter in response to your appeal of your Freedom of Information Law

request, received by the Division on February 15, 2024, in which you stated, “[w]e aim 

understand if DHR is suggesting no New York State records are available concerning this matter. 

Or, if DHR has redacted in part or withheld records in entirety marked as privileged. “

In your original request you sought “access to any and all records specific 

to Superintendent Harris' recusal(s) as of February 1, 2024.”

On February 2, 2024, the Division’s FOIL Officer issued a response to your request and 

stated the Division does not have any records in its possession that are responsive to your FOIL 

request. 

The response from the Division already specified the Division does not have any records

responsive to your request. Therefore your appeal is denied.
